GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Chevrolet planning new crossover between Equinox and Traverse

Chevrolet is taking a crowbar to its crossover lineup so it can slide in a new entry between the Equinox (shown) and the Traverse, according to a report in Automotive News. The current Equinox, a tweener compared to its rivals, will get smaller when the next-generation vehicle moves to the Delta platform that underpins the Chevrolet Cruze. The next Traverse will remain full-size, the liberated space between it and the smaller Equinox making room for a fourth offering from the brand. Designed on a short-wheelbase version of the Traverse platform, AN's sources say it will offer three-row seating, and its architecture will also serve the Cadillac SRX successor, the XT5, and the redesigned GMC Acadia. Yes, the Acadia will also come down a notch in size. Once all the rationalizing is complete, the Trax, Equinox, new crossover, and Traverse would give consumers a quicker, easier way to compare size and features with the competition. As it stands, the Ford Edge, Nissan Murano, Honda Pilot, and Toyota Highlander are all larger than the Equinox. The future offering and its two- and three-row seating options would take clear aim at those four vehicles, and the Equinox could focus on the Ford Escape, Honda CR-V, Toyota RAV4, and Jeep Cherokee segment. Seventies super-salesman challenges new car-sales record

Some of the fondest memories from my youth were the Sunday afternoons spent walking between rows of new and used cars. This preceded the advent of widely available internet, so the cars didn't sell themselves online: A tentative buyer had to come see the cars in the metal, with old-school salesmen taking well-earned smoke breaks after putting someone behind the wheel of a new Saab 900. All-inclusive subscription services were unheard of. If you open a Guinness records book and look up car salesmen, you'll find Joe Girard. The definitely old-school Detroit salesman regularly sold over 1,000 new cars per year, with a particular high point of 1,425 cars in 1973 guaranteeing him a mention in the Guinness book. To reach that kind of sales figure, you had to be a pretty special salesman, and Girard was. He didn't take breaks unless absolutely necessary, and even his lunch hours were dedicated to selling more cars instead of shooting the breeze with other sales persons. By 1977 he was worn through, having sold over 13,000 cars in his career, and his physique couldn't take it anymore. He's been a motivational speaker since. Now, 44 years later, a Dearborn, Mich., Cadillac and Chevrolet salesman named Ali Reda has reportedly broken Girard's record. The books at Les Stanford Chevrolet Cadillac say Reda sold 1,530 new cars and 52 used cars in 2017, averaging 130 vehicles per month. But after Girard, 89, heard of the sales record, he called his attorney, not letting his record be broken without a fight — or at least an audit. The Dearborn dealer isn't too concerned about Girard's doubts, at least according to Gary Stanford, whose father founded the dealership. "It's very official, trust me," said Stanford to the Detroit Free Press. "Ali is the hardest worker I've ever seen. And if someone doesn't believe the data, well, they're more than welcome to consult with GM. It's all there in black and white." What Girard doesn't get is that Reda was honoring him with the accomplishment. "I read his book, 'How to Sell Anything to Anybody,' and it said it would teach you how to become the best," said Reda, who at age 44 was a newborn when Girard hit his peak. "He's an absolute legend in the industry. Your whole career, you're chasing his name.
