GM threatens predatory dealers with order cancellations, non-transferrable warranties

General Motors will launch a second salvo against misbehaving dealerships next week with a new set of policies aimed at curbing predatory markup strategies. With the new Chevrolet Corvette Z06, GMC Hummer EV SUV and Cadillac Escalade-V about to head into production, GM is putting its foot down yet again. Dealers that attempt to circumvent GM's markup restrictions by dealing directly with brokers or other resellers could find themselves in a particularly nasty spot, as the company is threatening to withhold future allocations and end the transferability of warranties when dealers facilitate the reselling of vehicles within 12 months.  While this may help curb some dealership chicanery, it's possible the real loser in such a deal could end up being the customer who unwittingly ends up with an un-warrantied vehicle. We suspect GM has accounted for that, but we'll have to wait until next week to find out exactly how these new policies will be enforced.

General Motors has been happy to promote the 2016 Chevy Volt in the shiny blue color. On the company's website for the car, though, we can find all seven exterior colors, thanks to the magic of digital technology. We went through the site and played around with the option picker and put together a gallery of all the colors the new Volt will be available in as well as the five interior options. For the record, the exterior colors are: Kinetic Blue Metallic, Iridescent Pearl Tricoat, Summit White, Silver Ice Metallic, Mosaic Black Metallic, Siren Red Tintcoat, Heather Grey Metallic. You'll be forgiven if you can't quite tell the difference between the Pearl and the White in these images, but both colors have been available on the 2015 model year Volt. GM spokesperson Michelle Malcho told AutoblogGreen that buyers do have a preference, with Pearl accounting for 10 percent of the sales and Summit White accounted for 17 percent. The Pearl color is a tri-coat and thus has a $995 price premium, which was likely a factor as well. The interior of the new Volt will have two cloth options (Dark Ash and Jet Black) and three leather choices (Dark Ash, Jet Black, and Jet Black/Brandy). That last one will only be available in the LTZ trim level. You can play around with the color adjuster yourself here. Kathy Sirvio, the color and design manager of the Volt design team, told AutoblogGreen that, "Kinetic Blue is a marketing name. At Design we call it 'Blew Me Away'. That is it in a nutshell. The blue color is vibrant, rich and eye catching. It may not sell at the highest volume, as we know from history whites, blacks and silvers are the dominant color sales. However, it will tell everyone who sees it on the street that here comes a new vehicle and it is expressive in all the right ways." The next-gen Volt arrives later this year with a starting price of $33,995. The powertrain upgrades will push the all-electric range to 50 miles and the gas-only fuel economy to 41 miles per gallon. GM is the latest automaker accused of diesel emissions cheating

Volkswagen and Ram need to make room on the diesel-emissions bench for General Motors. America's largest automaker was accused in a lawsuit on Thursday of rigging hundreds of thousands of diesel trucks with at least three so-called defeat devices to ensure that the trucks would meet federal and state emission standards, even if they generated more pollution in real-world driving. According to the complaint, on-road emissions testing conducted for the plaintiffs found that Duramax-equipped trucks produced NOx pollutants, comprised of nitrogen and oxygen atoms, two to five times higher than legally permitted, and "many times" higher than their gasoline counterparts. The proposed class-action lawsuit was filed in federal court in Detroit on behalf of people who own or lease more than 705,000 Chevrolet Silverado and GMC Sierra pickup trucks fitted with "Duramax" engines from 2011 to 2016 model years. The lawsuit seeks remedies including possible refunds or restitution for lost vehicle value, plus punitive damages. It adds to legal problems for Detroit-based GM, which has already paid about $2.5 billion in penalties and settlements over faulty ignition switches linked to 124 deaths. GM joins at least five automakers whose diesel emissions have been scrutinized by regulators or consumers. They include VW, which has admitted to cheating; Mercedes-Benz parent Daimler; Fiat Chrysler Automobiles, Peugeot and Renault. GM spokesman Dan Flores called the claims "baseless," and said the trucks comply with US Environmental Protection Agency emissions standards and California's own tough standards. Shares of GM were down 69 cents, or 2.1 percent, at $32.50 in afternoon trading, after earlier falling to $31.93. The GM lawsuit was filed by several law firms, including Hagens Berman Sobol Shapiro, which helped reach multibillion-dollar settlements with VW on behalf of drivers and dealers. The case is Fenner et al v General Motors LLC et al, US District Court, Eastern District of Michigan, No. 17-11661. The named plaintiffs are Andrei Fenner of Mountain View, California and Joshua Herman of Sulphur, Louisiana. They said they would not have bought their respective 2011 Sierra and 2016 Silverado trucks, or would have paid less for them, had they known about the alleged rigging. Joseph Spak, an RBC Capital Markets analyst, in a research report said "negative publicity" from the lawsuit could drive buyers to trucks from Ford or even Fiat Chrysler's Ram.
