GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. A conversation with GM's Mark Reuss on MPG, aluminum and Corvettes

There was plenty to talk about when General Motors hosted its annual mid-December holiday media reception a few months ago. GM had just decided to pull its global Chevrolet brand out of major European markets, where Chevys have competed directly with GM Europe Opel and Vauxhall vehicles, and the US government had sold its last remaining shares of GM stock. But most important was the company's just-reshuffled leadership. Post-bankruptcy CEO Dan Akerson had announced that he would step aside and that 52-year-old Mary Barra would replace him on January 15. Not only would she be the first woman to lead a major automaker, she would also be GM's first engineer CEO since Bob Stempel in the early 1990s. "I look at 2013 and 2014, as the retooling of General Motors" - Mark Reuss Replacing her as executive VP for global product development (and purchasing and supply chain) would be 49-year-old Mark Reuss, who had served a stellar four years as North American president, and elevated to corporate president (from executive VP and CFO) would be 42-year-old Dan Amman. All three are relatively young auto enthusiasts who are liked and respected inside and outside the company, and their collective talents and experience are highly complementary. I've interviewed Barra and found her smart, personable and knowledgeable, though she carefully walks the corporate line in speaking and answering questions. I met and chatted with Ammann for the first time at that holiday reception, and he made a good first impression. But I've known Reuss for some time as a genuinely good guy and a highly capable and inspiring leader, and I believe he is exactly the right person for the global product responsibility once famously held by the outspoken, oft-controversial Bob Lutz. So I jumped at an opportunity to join a group interview of Reuss (with mostly business reporters) at the Detroit Auto Show in January. It was an interesting session of mostly good questions, which he answered with refreshing candor and humor. "I look at 2013 and 2014, as the retooling of General Motors," Reuss said. "We've taken down almost every plant in North America, converted and turned it this last year, and to do that with award-winning vehicles and pretty flawless launches is key. We have to keep the train rolling on great product, because the rest won't happen without the best product, period." A reporter asked whether GM was pushing big trucks, SUVs and Corvettes again because gas is cheap. "No," Reuss said.

2016 Chevrolet Camaro: Notes from the reveal

The 2016 Chevrolet Camaro debuted Saturday evening in Detroit at an enthusiast-oriented event near the city's IndyCar course. While the big news was the Camaro's 200-pound weight loss, tighter chassis, and a snorting new V8, plenty of other morsels of Camaro info came out. Here's some of the more interesting stuff we heard. • The 2.0-liter inline four-cylinder is the first turbocharged engine in a Camaro. • The LT1 borrowed from the Corvette Stingray marks the third time a Camaro has used an engine with that badge. It was previously used in 1970-72 (Z/28), 1993-97 (Z/28), and 1996-97 (SS). • The Camaro was revealed in a tent before nearly 1,000 enthusiasts, General Motors executives (including CEO Mary Barra) and mere feet from the Grand Prix course where IndyCars will run in two weeks. • Chevy hopes to continue to attract new customers with the Camaro and said 63 percent of the fifth-generation buyers were new to the brand. • GM product boss Mark Reuss neatly summed up the Camaro's handling character. "It's wicked fast and extremely nimble." • Reuss on the design goal: make it "look like a car for tomorrow instead of a car from yesterday." • Reuss' first car was a 1967 Camaro, and he's reiterated his passion for the car. "People want to be seen in a Camaro, and that never goes away." • Chevy North America president Alan Batey said he plans to line up a red Camaro as soon as the order bank opens. We assume he'll have early access to that. • Though the appearance is similar, the sixth generation of the Camaro appears a little sleeker and is more aerodynamic thanks to 350 hours in the wind tunnel. Only two parts, the SS badge and the rear bow-tie emblem, are carryover. • Al Oppenheiser, the Camaro's chief engineer, said most of the options (except Magnetic Ride Control, which is SS exclusive), will be offered on the inline four. The engine will be capable of propelling the Camaro to a sprint to 60 miles per hour in well under six seconds. "We don't want to ... make it feel like an excuse car," he said. • Without revealing specifics, Oppenheiser said every Camaro variant will be faster than the model it replaces. •The interior is vastly improved. We got an up-close look in the cabin of one of the cars revealed with a red and white layout, and the materials are much better.
