GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. The outsized monster you see before you started life as a Chevrolet Camaro ZL1, and then went through a big-time Hollywood makeover before being positioned on the Chevrolet stand here in Chicago.
This 2013 "Turbo" Camaro Coupe is getting the promotion machine ratcheted up for a new DreamWorks tale by the name of, you guessed it, Turbo. Coming this summer, the movie will follow one snail's quest to become a race driver worthy of making the cut at the Indy 500. Like many DreamWorks vehicles before it, we're guessing that the petrolhead snail will star in a movie that adults (especially racing fans) with have no trouble watching with their kids. As for the car, we're told that it is "instrumental" in transforming Turbo from snail into racer. Helping the beastly pony car in this mighty task, is an ankle-cracking front splitter matched by a ungodly huge rear wing out back, a COPO hood and a supercharged (yes, supercharged) V8 engine making more than 700 horsepower. 24-inch wheels all the way around - 10-inches wide in front and 15-inches wide in back - should allow the "Turbo" Camaro to hook up with ease, as well.

2018 Hyundai Accent vs subcompact sedans: How it compares on paper

Hyundai first revealed the new 2018 Hyundai Accent a few months ago, but that debut was in Canada for the Canadian-market car. We didn't get our look at the U.S. version until just recently, which is when we also finally got plenty of specifications on the little car. So as we did with the Genesis G70, we've brought you a breakdown of the Accent's specs and some of the segment's best and most popular: the Nissan Versa, Kia Rio, Chevrolet Sonic and Toyota Yaris iA. Before we get to the chart, let's give you a quick reintroduction to the 2018 Accent. The subcompact is completely new this year, and under the hood is again a naturally aspirated 1.6-liter four-cylinder engine. It makes 7 fewer horsepower and 4 fewer pound-feet of torque than the outgoing model with totals of 130 horsepower and 119 pound-feet. This drop in power probably won't be noticeable, though. It's also available with either a manual or automatic transmission, both featuring six speeds. Fuel economy hasn't been announced, but the Rio's numbers below are probably a good indicator as they share powertrains. The one thing that isn't available with an Accent is a hatchback. According to Autoweek, the hatchback was canned with the assumption that hatch buyers would simply purchase an example of the upcoming Kona crossover. But if you want a traditional subcompact hatch from South Korea, Kia is happy to oblige, as the Rio is still available as a hatchback. Learning that the Kona may have killed the Accent hatch causes us to wonder if Kia brought the Rio hatch to the U.S. because it wasn't planning on offering the Stonic.
