Fingers point to dragged-out NHTSA investigation after second death by ARC airbag inflator
Thu, Oct 14 2021Safety advocates have increased criticism of the federal government's National Highway Traffic Safety Administration after an exploding airbag inflator that's been under investigation for more than six years killed a second person. On Wednesday, NHTSA posted recall documents filed by General Motors that revealed the second death, the driver of a 2015 Chevrolet Traverse SUV with an inflator made by Tennessee company ARC blew apart, spewing shrapnel. No details were given about where and when the death occurred. NHTSA has said that ARC Automotive of Knoxville has manufactured about 8 million inflators used nationwide in vehicles made by General Motors, Fiat Chrysler (now Stellantis), Kia and Hyundai. “NHTSA should have been all over this along time ago,” said Rosemary Shahan, president of California-based Consumers for Auto Reliability and Safety. “There's just no denying that itÂ’s a (safety) defect.” NHTSA, the agency charged with with keeping America's automobiles and roads safe, began investigating ARC inflators in July of 2015 after two people were injured by flying shrapnel. The investigation became more urgent in 2016, when a Canadian woman driving an older Hyundai Elantra was killed by metal airbag fragments. Public records show only a little progress on the probe. In April, the agency posted a memo in saying it was reviewing volumes of information it received from ARC. Safety advocates such as Shahan say that the dragged-out investigation is an example of the deadly consequences that can result from an understaffed and underfunded agency. The second death should not have happened, Shahan said, and vehicles with faulty ARC inflators should have been recalled faster. The agency, Shahan said, is “grossly underfunded," but it still should have sought recalls of the ARC inflators. She said historically NHTSA has taken little action during Republican administrations but has ramped up safety efforts when Democrats control the White House. Messages were left Wednesday by the Associated Press seeking comment from NHTSA and ARC. At this time, relatively few vehicles are effected. The GM recall covers only 550 Chevy Traverse SUVs from the 2013 through 2017 model years, as well as Buick Enclave SUVs from 2008 through 2017. The automaker said in a statement that the faulty front driver's airbag inflators were either installed at the factory or in replacement airbag modules.
Weekly Recap: Ford guns for 2016 Le Mans glory with new GT
Sat, Jun 13 2015On the eve of the 24 Hours of Le Mans, Ford confirmed it will return to the French endurance race in 2016 and campaign the new GT racecar 50 years after three GT40s swept the podium at the Circuit de la Sarthe. The factory will back a two-team, four-car effort that will compete in the World Endurance Championship and the Tudor United SportsCar Championship running cars operated by Chip Ganassi Racing with Felix Sabates. The GT racecar will make its track debut in January at the Rolex 24 at Daytona, and the driver lineup will be announced later. "But rest assured, there's quite a line forming out the door," Ganassi said at the announcement. The GT is the modern successor to the iconic GT40, which won Le Mans four straight years from 1966-1969. The racecar is a rolling testbed of Ford's latest technologies, including a powerful twin-turbo EcoBoost V6. The car also makes extensive use of carbon-fiber pieces and advanced aerodynamics. Ford tapped Multimatic Motorsports of Canada and Roush Yates Engines to aid in the development of the GT racer. The road-going version, which was revealed in January at the Detroit Auto Show, is also set to launch next year. It caps Ford's growing performance lineup, and the company has ambitious plans to launch more than 12 new sporty models by 2020, including hot metal like the Focus RS, F-150 Raptor, and Shelby GT350R. The GT embodies Ford's best tech, but news of its return to Le Mans immediately conjured images of the company's fierce rivalry in the 1960s with Ferrari and intense competition with Porsche. "When the GT40 competed at Le Mans in the 1960s, Henry Ford II sought to prove Ford could beat endurance racing's most legendary manufacturers," Ford executive chairman Bill Ford said in a statement. "We are still extremely proud of having won this iconic race four times in a row, and that same spirit that drove the innovation behind the first Ford GT still drives us today." Ford is going back to Le Mans. Somewhere, Hank the Deuce must be smiling. OTHER NEWS & NOTES 2016 BMW 7 Series arrives in the fall BMW revealed the sixth generation of its flagship 7 Series this week, which will start at $81,300 when it launches in the United States this fall. GM does not have to turn over its ignition switch documents
Fri, Nov 27 2015In June the lawyer representing plaintiffs suing General Motors over faulty ignition switches accused GM and its firm King & Spalding of working together to cover up the malfunction. Bob Hilliard said that certain communication between GM and King & Spalding from 2010 to 2013, mainly focused on three Chevrolet Cobalt crashes, would reveal that they conspired in "burying what they knew" concerning the defect, and furthermore that the law firm broke rules of professional conduct once it found out about "ongoing fraudulent concealment" at GM. Hilliard filed a motion in a Manhattan court to force GM and King to hand over the memos, which were protected by attorney-client privilege. Hilliard said that the alleged ongoing fraud should trump attorney-client privilege, a GM spokesman said at the time that the issues in question had already been discussed previously, and that plantiffs already had much of the communication Hilliard's motion sought. US District Judge Jesse Furman ruled in favor of GM and King, refusing to order the release of the communication. In spite of finding probable cause that GM was engaging in a crime or fraud by not revealing the ignition switch defect, Furman did not find cause to believe that GM and King's discussions at the time were centered around continuing that potential crime or fraud. Saying also that plantiffs already had many of the disputed documents, attorney-client privilege should hold sway over the remainder. The class action case goes to trial in January 2016.
