GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Should heavy-duty pickup trucks have window stickers with fuel mileage estimates?

If you were to stroll into your nearest Chevrolet, Ford, GMC, Nissan, or Ram dealership, you'd find a bunch of pickup trucks. Most of those would have proper window stickers labeled with things like base prices, options prices, location of manufacture, and, crucially, fuel economy estimates. But you'd also run across a number of heavy-duty trucks with no such fuel mileage data from the Environmental Protection Agency. The EPA doesn't require automakers to publish the valuable miles-per-gallon measurement for vehicles with gross weight ratings that exceed 8,500 pounds. That makes it difficult for consumers to compare behemoths powered by turbocharged diesel engines – between one another, and between smaller, gasoline-fueled trucks. Consumer Reports doesn't think it should be this way, and it's spearheading an effort (PDF link) to get the government to require manufacturers to publish fuel economy estimates. In its own testing, CR found that heavy-duty pickups powered by Ford's Power Stroke, GM's Duramax, and FCA's Cummins diesel engines (which doesn't include the Ram's EcoDiesel) get worse fuel mileage than their lighter-duty gas-powered siblings. We're not so sure HD-truck buyers are unaware of this fact – big diesels don't really come into their own until big loads are placed in their beds or attached to their trailer hitches. Under heavy workloads, the diesel trucks will almost certainly return greater efficiency than a similar gas-powered truck. What's more, HD trucks with lumbering diesels in general make the driver feel more confident while towing due to greater torque at low engine RPM than gas trucks. They also offer greater max-weight limits. Still, we agree EPA fuel mileage estimates should be offered for heavy-duty pickups. GM will make Chevy Volt production announcement tomorrow

Thing are apparently happening to get the next-generation Chevy Volt ready for public consumption. The most obvious proof is in a preview of an announcement (possibly coming tomorrow) that the two main places where General Motors gets the Volt ready -the Detroit-Hamtramck Assembly Plant and the Brownstown Township battery assembly facility - will be getting big money upgrades and lots of new positions. The Hamtramck plant builds the Volt and its fancier cousin, the Cadillac ELR, as well as the global versions of the Volt. The Detroit News reports that GM will add 1,400 jobs and spend roughly $450 million at the two locations in order to build the redesigned Volt. What's less clear is exactly what the updates will bring us. We've heard that the new volt will be a 2016 model and come on a new chassis. Speculation in The Detroit News about tomorrow's announcement runs the gamut from a new compact PHEV with less electric range and a lower price (which makes sense) to an updated Volt with more electric range (heard it before) to a new all-electric vehicle (the moon shot). If there's any hints to be gleaned in the international Volts, there are also reports coming in that the Opel brand will get an all-electric vehicle that is cheaper than the Ampera. Read into that what you will. We pestered GM's Kevin Kelly on the new Volt (again) and he said (again) that he couldn't give out any more detail other than what's been reported. He just told AutoblogGreen that there will be an announcement tomorrow and that it will be about the Hamtramck and Brownstown facilities and involve the Volt. So, stay tuned.
