GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. GM global sales off slightly this year

General Motors saw a slight dip in global sales through the first nine months of the year. In that time, the automaker moved 7.2 million vehicles – down 1.3 percent from 2014. For the third quarter alone, the numbers were down 3.1 percent with a worldwide volume of 2.3 million. The automaker had a better performance in North America, as Chevrolet is showing strength with some of its best crossover sales ever, and pickup trucks were up 16 percent for the year. Volume on the continent advanced 4.9 percent through September to nearly 2.7 million vehicles. The third quarter improved that figure even further with a 5.2-percent jump and deliveries of about 931,000. Elsewhere in the world, things were more mixed in the third quarter. European deliveries jumped 1.1 percent, but the company was still down 6.3 percent there for the year so far. Volume in China also fell 4.2 percent, but the country showed 1.6-percent growth through the first nine months. South America took the biggest, hit with Q3 numbers dropping 30.8 percent. While GM is seeing a small sales drop globally, the company could still climb up the ranking of the world's largest automakers by the end of the year. "At the same time, we have reacted quickly to challenging macroeconomic environments in other markets and have shown the discipline to exit situations where we see no long-term path to acceptable returns." Examples of GM's recent success include: GM truck sales in North America were up 16 percent in the first nine months of 2015, driven by a 17 percent increase in Chevrolet truck deliveries in the United States.

Nissan Leaf is now the best-selling plug-in vehicle of all time in US

Numbers don't lie. And in some instances, you can see their truth from miles away. As everyone expected, the Nissan Leaf is now officially the best-selling plug-in vehicle in the US. While the two vehicles aren't direct competitors (one's a pure EV and the other is a plug-in hybrid), they certainly dominate the plug-in vehicle sales charts. When we do a little math on those charts, we see that since the two vehicles went on sale at the end of 2010, the Volt has sold 75,231 units while the Leaf is now at 76,407, giving the Leaf a 1,176-vehicle lead. The Leaf trailed the Volt by just two units at the end of February. This is the first time the EV had held the overall lead since the end of February 2012, when it was ahead 10,847 to 9,623 and for a while there at the end of 2013, the Volt was up by around 12,000 units. Times have changed, though, and we don't expect the lead to switch back until the next-gen Volt goes on sale later this year, and even then nothing is certain. The Leaf sold 1,817 copies last month, a drop of 27.5 percent from last year. Year-to-date, the Leaf has sold 4,085 units, down 21.2 percent from the same time period in 2014.
