Did BMW drag its feet on Mini recall?

The National Highway Traffic Safety Administration is opening an investigation into BMW's reporting of a recall for 30,456 examples of the 2014-2015 Mini Cooper Hardtop, Cooper S, and the 2015 John Cooper Works. According to the government, "it appears from a review of NHTSA's databases that BMW may have failed to submit recall communications to NHTSA in a timely manner." The automaker issued the recall in July because crash tests showed the models didn't meet side impact requirements for passengers in the back seat. While there were no reported injuries at the time, the company decided to install energy-absorbing material in the space between the rear interior panels and the exterior. However, NHTSA has decided to investigate whether this campaign should have started much earlier, given the evidence the company had. According to the government's report, the Cooper Hardtop failed side-impact tests in 2014, although one of these tests was five-miles-per-hour faster than the Federal Motor Vehicle Safety Standard. The agency claims: "In January 2015 BMW verbally committed that it would conduct a service campaign to add padding to the rear side panels of MY 2015 Mini 2 Door Hardtop Cooper models. However, BMW did not initiate the service campaign and failed to inform NHTSA of its failure to do so." A subsequent crash test of an example with this fix showed it to make the vehicle compliant with the rules. Mini spokesperson Mariella Kapsaskis told Autoblog: "Regarding the NHTSA audit query, BMW Group is evaluating the request and will respond to NHTSA as appropriate." For the fourth year in a row, fuel economy is the biggest factor in buying a new vehicle. A new report from JD Power and Associates found that, despite cheaper gas, customers still sought out fuel-sipping cars. 14 percent of survey responders cited mileage as the biggest concern when shopping for a new car, and the second most important reason to reject a vehicle. The biggest deal-breaker, though, when it comes to buying a new car is much more superficial: 30 percent of shoppers cite appearance as the main reason to avoid buying a particular vehicle. Read more at Automotive News, or in the press release below. Tesla's 6.1 Firmware update for the Model S makes maneuvering the car in reverse a bit easier. The update includes reverse guiding lines for the rear-view camera when backing up. Combined with the parking sensors, the new lines in the display make it easier to place the car into parking spots by showing where the car will be positioned based on the angle of the steering wheel. The 60-second commercial will play during the first quarter of the game on Sunday, February 1. BMW didn't give the whole idea behind the TV spot away, but did hint at the concept behind the ad. Bunny couldn't out hop a BMW M3 on-track

Driving a car is a dangerous hobby, and not just because of other drivers or poor roads. Sometimes, it seems like even the wildlife is out to get you, as evidenced here, here, here, here and here. Now, we can add one more unfortunate car-versus-animal encounter to the tally.
Perhaps believing that this bright orange BMW M3 GTS was a very fast, very loud carrot, an unfortunate bunny leaped into its windshield in a brutal accident at a Polish racetrack. Considering the M3's speed at the time, 89 miles per hour, the passengers are lucky to be okay. Obviously, Bugs didn't make it.
The BMW isn't in such great shape, though. The windshield is in a bit of a state, with safety glass sprayed all over the passenger side of the cabin. There doesn't appear to be any sheetmetal damage, at least from what we can tell from the video. Although there isn't any blood, the hit is really hard. The initial point of impact is at 0:57.
