EPA message to automakers: You're on notice

With top administrator Gina McCarthy speaking about the "moral obligation for climate action" on Friday, the Environmental Protection Agency announced it would ramp up its oversight of the auto industry in the wake of Volkswagen's emissions cheating. In a letter sent to manufacturers Friday, the agency said it would begin examining cars to see whether they contained defeat devices "in addition to the standard emissions test cycles." "We are putting vehicle manufacturers on notice." Exactly how the agency plans to test for these devices – which are not devices per se, but algorithms contained in millions of lines of software code that govern vehicle functions – remains unclear. Christopher Grundler, the director of the EPA Office of Transportation and Air Quality, divulged few details in how the agency would uncover so-called defeat devices used by cheaters. "Not today – or actually ever – I'm not going to be describing what new ways we'll be using to detect these defeat devices." Later, he said engineers will have to "come up with some clever ways to do this." The only insight he offered was that the EPA, California Air Resources Board, and Environment Canada would partner on testing more cars for emissions and anomalies. Grundler also said the EPA would diversify its testing fleet. In addition to relying on vehicles provided by manufacturers, the federal agency will now also borrow cars from "private citizens" and utilize rental cars for tests. "We are putting vehicle manufacturers on notice," he said. Joint investigations between EPA and CARB have "been very successful in protecting human health and the environment," said Janet McCabe, the agency's acting administrator in the Office of Air and Radiation. "But we also know, and the Volkswagen violations before us now make it clear, we need to adapt and step up our oversight." That may include an increase in on-road testing in addition to the five emissions tests now more relied upon. The EPA owns and maintains 23 portable emissions-monitoring systems like the one used by West Virginia University researchers who first detected elevated levels of nitrogen oxide emissions from two Volkswagen diesel vehicles. Right now, they're almost exclusively deployed to monitor emission from heavy-duty vehicles, whose NOx emissions "dwarf" the amount produced by light-duty vehicles, which produce less than 2 percent of the total, according to the agency's figures.

France may still ban diesel vehicle sales

Legislators in France are not afraid to bring out the ban hammer when it comes to dirty vehicles. The city of Paris has implemented bans on old clunkers, and the French Prime Minister, Manuel Valls, said in 2014 that diesel cars were a "mistake" and that the government would "progressively undo" the error. Now the national government has said it will not rule out banning sales of new diesel vehicles by Renault and Volkswagen if those companies don't answer more questions about their vehicles' emissions. Environment Minister Segolene Royal said last week that France wants more information about the VW diesel defeat device and Renault's engine software. "We will be asking the consumer fraud investigators and prosecutors to communicate any findings that will enable us to establish whether it's necessary to withdraw sales authorizations," Royal said. Royal has been making waves recently at the COP22 meeting in Marrakesh, Morocco and said that Donald Trump's environmental policies will be " absolutely catastrophic" and weaken the US' standing in the world. If the US doesn't want to lead on climate change efforts, she said, "China can take the place of the United States." She has also been involved in a controversy at home over votes that her staff made to allow higher emissions level from vehicles. Canada expands cooperation with EPA over VW scandal

It doesn't take much more than a stiff breeze to send some US pollution northward across the 49th parallel. Perhaps that's why the Canadian government says it is standing strong with the US in its continuing investigation of Volkswagen and the allegations and self-reporting that the automaker installed software to try to game emissions regulations. In fact, the Canadian government is going to do its own slate of on-road testing to see how VW diesel engines perform in real-world conditions. Last year, about 1.8 million new light-duty vehicles were sold in Canada, which is about equal to how many were sold in Maryland. That compares to about 17 million new-vehicle sales for the US. But every bit counts when it comes to an increase in potentially harmful emissions, and the Canadian government says it wants to make sure VW's diesel engines are being properly monitored, whether they're sold in Detroit, MI, or across the river in Windsor, Ontario. And that means following up – together – on allegations that Europe's biggest automaker is using so-called "defeat devices" in what it has long called its "clean diesel" engines. The automotive industry continues to be roiled by the VW scandal, in which the automaker said that as many as 11 million of its vehicles may contain software programmed to manipulate emissions-testing procedures. Volkswagen has set aside $7.3 billion to deal with the scandal, while VW CEO Martin Winterkorn was forced to step down after the issue became public.
