Audi A3 diesel fails independent emissions test in Europe

The best-selling model under Volkswagen's Audi division was emitted about double the legal limits of nitrogen oxide (NOx) levels for Europe, Reuters says, citing laboratory tests overseen by the European Commission's Joint Research Center (JRC) in August. The Audi A3 was found in two tests to emit about double the legal limit of NOx, though one of the tests had the A3 within the limits when the engine was cold. An Audi spokesman told Reuters that the A3 was independently tested to have emissions levels within the legal limit and that he wasn't aware of the JRC test results. Still, the findings are another example of how Volkswagen, Europe's largest automaker, can not seem to shed the issues surrounding the diesel-emissions scandal that broke last September. VW has been fined about $19 billion for equipping diesel cars with software that cheats emissions-testing systems. About 11 million cars were affected, including about a half-million vehicles in the US. In addition reaching a $15 billion settlement with US regulatory bodies such as the Environmental Protection Agency (EPA) and the California Air Resources Board (CARB) earlier this year, VW has been fined $15 million by the South Korean government, which may impose more penalties because of allegations of false advertising. Audi is not the only VW unit to face further scrutiny. Germany's Transport Ministry and Federal Motor Transport Authority are taking a closer look at VW's Porsche division for potential emissions-cheating efforts, Bloomberg News recently reported. Additionally, the European Union is saying that at least seven of its member nations failed to provide sufficient oversight of automobiles' emissions-testing process, and may take legal action against Germany, Spain, Luxembourg, Czech Republic, Lithuania, Greece, and Great Britain, according to a separate Reuters article. VW diesel incentives could be fuel for prosecutors

In the 2000s, Volkswagen was among the companies that lobbied the government to get buyers of diesel vehicles a tax credit. The automaker even brought some of these models to Washington to show them to politicians. The incentive eventually passed, and about 39,500 customers of the 2009 Jetta TDI and Jetta SportWagen TDI got a $1,300 benefit – for a total cost of around $51 million. Now, according to Reuters, that politicking might come back to bite the automaker when prosecutors finally get cases to trial. The US Department of Justice, the Environmental Protection Agency, and attorneys general in at least 29 states are already investigating VW, and politicians are pushing for criminal and civil actions against the company. According to Reuters, there could be several legal routes available, too. One option is to bring tax fraud charges, and that would require proving the automaker knew it was making untrue claims about the diesel models. There's also the option of bringing a case under the False Claims Act, which prohibits fraud against the government. According to Reuters, a maximum penalty under the law would be three times the tax credit and another $5,000 for each vehicle that received it. The company is also facing a class-action lawsuit from disgruntled owners. To aid its defense against all of these claims, VW has hired the same firm that worked with BP during the Deepwater Horizon oil spill. Outside of the US, prosecutors in Germany have just started to build a case against former CEO Martin Winterkorn for alleged fraud. In addition to these potential legal penalties, VW could be fined around $18 billion by the EPA for the emissions infractions. The agency's investigation is getting the added backing of its Canadian counterpart. Although, the actual settlement is expected to be far less.

NA auto output to reach 11-year peak

According to Automotive News, automakers are expected to manufacture 16 million light vehicles in North America in 2013. That's up 500,000 units from last year and marks the largest number since 2002. The prediction comes courtesy of LMC Automotive and IHS Automotive, which point to the improving US economy as a bellwether for total production. LMC Automotive says North America will produce 16 million vehicles while IHS has a slightly more optimistic forecast of 16.1 million units. A total of seven automakers are slated to increase production on the continent this year. Nissan is set to see the largest jump at 20 percent over last year.
Volkswagen, meanwhile, is one of the only manufacturers predicted to scale back production. Analysts expect the German company's output to fall by 23 percent to 170,000 units, thanks in part to slow demand for the Volkswagen Passat and Jetta.
