CARB has 20 days to confirm VW's 3.0-liter TDI emission fix

VW's diesel scandal has been in the headlines since last September, but solving the problem it proving difficult. Volkswagen Group has submitted a proposal to the California Air Resources Board (CARB) and the Environmental Protection Agency (EPA) to fix about 85,000 vehicles with the 3.0-liter diesel V6 in the US, Reuters reports. CARB now has 20 business days to test if the plan actually reduces emissions. If accepted, VW could finally begin a recall and end the stop sale on vehicles with these engines. In a statement, CARB pledged to, "respond following a thorough and complete review to make sure the plan addresses the presence of the illegal defeat device and follows the necessary environmental, vehicle and public health and safety regulations." Neither CARB nor the EPA outlined the proposed repairs, but Porsche CEO Oliver Blume already suggested the fix for the engine in the diesel Cayenne. Examples from 2013 and 2014 allegedly need a new catalytic converter and software update, and those from 2015 and 2016 only need the improved code. It's not yet clear whether this procedure would work for all models with the 3.0 TDI. While the EPA issued the notice of violation against VW's 2.0-liter four-cylinder diesel in September, the first one for the 3.0-liter V6 came in early November. By the end of the month, the agency broadened the scope to about 85,000 vehicles, including some examples of the VW Touareg, Audi A6, A7, A8, Q5, Q7, and Porsche Cayenne. The affected companies issued stop sales on new models with the engine. Audi eventually admitted to regulators that it didn't disclose three auxiliary emission control devices in the powerplant's code and promised to develop a software update to fix the problem. CARB gave the automaker 45 business days to submit the proposed solution. If accepted, this repair would allow VW Group to end part of the emissions scandal, but there's no guarantee the regulators consent to this solution. Just a few weeks ago, CARB looked at the automaker's plan to fix the 2.0-liter TDI and rejected it, claiming a lack of detail.

VW sales increase 0.6% in September despite diesel scandal

Volkswagen was spared in the month of September from posting a sales disaster, but in reality, the impending doom and gloom is likely just postponed until October. According to VW, it delivered 26,141 vehicles to its dealerships last month, which represents a 0.6-percent gain over the same period a year ago. While up, that meager increase represents the smallest uptick of all major brands in the United States, which is currently in the middle of the best vehicular sales year in the last decade. Audi, the German automaker's mainstream luxury unit, saw a bigger gain at 16.2 percent with 17,340 total units sold, thanks in large part to the popularity of its crossover models. These numbers can't totally be taken at face value, however. In 2014, Labor Day weekend was counted as part of August's sales figures; in 2015, that traditional car-buying holiday fell early in September and is therefore partly responsible for the huge increases from all brands doing business in the United States. Remember, the diesel emissions scandal didn't hit the news until September 18, which means VW was free to sell its 2.0-liter TDI engine for the majority of the month. In other words, October is going to be the real indicator of sales reckoning as it will be the first full month that the brand can't sell its popular diesel models and the first since its emissions scandal broke. Still, TDI sales were down last month. VW reports a total of 3,060 sales of vehicles equipped with TDI engines, which represents 11.7 percent of total volume. That's nearly cut in half from the TDI's year-to-date volume percentage of 20.4 percent. "We would like to thank dealers and customers for the support of the Volkswagen brand," said Mark McNabb, chief operating officer for Volkswagen of America in a statement. "Volkswagen will continue to work diligently to regain trust and confidence in our brand." It's not yet clear exactly when VW will issue a fix to make its 2.0-liter TDI engine emissions legal, or when the EPA will recertify those models for sale. Once those two things happen, dealers will again be free to sell vehicles equipped with the powertrain, but even then it remains to be seen how consumers react when the sales ban is lifted. Angry diesel owners joining lawsuits against Volkswagen [w/video]

Livid at the prospect of losing thousands of dollars from the value of their cars and performance from their diesel engines, many owners of Volkswagens are headed to court. A law firm with a track record of suing automakers has already filed three class-action lawsuits against the German automaker related to its emissions-cheating scandal and says a fourth one is on the way. The lawsuits, filed by national firm Hagens Berman, accuse Volkswagen Group of America of fraudulent concealment, false advertising, and violations of federal and state laws. Plaintiffs in all 50 states have joined the class-action suits, according to the firm. A spokesperson says there has been "an unprecedented response" since the first lawsuit was filed within hours of an announcement from federal regulators last Friday. The lawsuits accuse Volkswagen Group of America of fraudulent concealment, false advertising, and violations of federal and state laws. Diesel owners paid thousands more for their vehicles instead of their gasoline-powered counterparts because Volkswagen's diesel engines ostensibly offered both torque and fuel economy. Now affected car owners are faced with a double-whammy – the value of their cars has diminished with the news and the purported software fix that brings the cars in emissions compliance will likely lower their performance and gas mileage. "Hundreds of thousands of consumers put their trust in VW when they looked to its 'Clean Diesel' line for an efficient, environmentally conscious diesel option," said Steve Berman, managing partner. "But for years, VW cheated the system. Its TDI line of fast but 'good-for-the-environment' cars seemed too good to be true, and they were." In its latest court filing, Hagens Berman lawyers said that car owners believed their vehicles were in compliance with Environmental Protection Agency standards and that the cars would retain their operating characteristics throughout their useful lives. Another firm, Girard Gibbs, has also filed a lawsuit over the diesel deception. "These Volkswagen vehicles should never have been sold, and certainly should not have spent the past six years on American roads polluting our air," said Eric Gibbs, the lead attorney. "Not only does this kind of fraud harm consumers and the environment, it negatively impacts competition, which is what drives our free-market system.
