Winterkorn not under official investigation in Germany

Prosecutors for the state of Lower Saxony in Braunschweig, Germany, are now saying that former Volkswagen CEO Martin Winterkorn is no longer specifically under investigation for his role in alleged fraud related to the automaker's diesel emissions scandal. The lawyers are clarifying that there's no formal inquiry into the exec because there's not yet enough evidence to establish a suspicion of wrongdoing, Bloomberg reports. However, they are still looking into VW's actions. Earlier this week, the prosecutors announced they had begun an initial investigation into Winterkorn for alleged fraud in the emissions regulation evasion. At that time, there were reportedly 12 complaints asking the lawyers to look into the case, including one from VW. Under German law, only a person could be charged for the potential crimes, rather than a whole company. "An initial suspicion must be based on facts, and you must begin an investigation before you can establish the facts," Christoph Schalast, a professor at the Frankfurt School of Finance, said to Bloomberg. Meanwhile in the US, the investigation continues into VW. The Department of Justice has the support from at least two senators to pursue criminal and civil charges against the company. The attorneys general in at least 29 states are also looking into things. Meanwhile, lawyers are building a class-action lawsuit, as well. 1 in 7 Americans say they might buy an EV next, as sales of electrics surge

About one in seven driving Americans may likely purchase an electric vehicle as their next car, according to an AAA poll, meaning that as many as 30 million Americans may pony up for an EV within the next three to five years. While some of the motivation is environmental, survey recipients say that lower maintenance expenses and solo access to high-occupancy-vehicle lanes are also among the factors behind potentially going electric. The poll indicates that about as many people are planning to buy an EV for their next car as are looking to buy a pickup, which is impressive given that the best-selling US vehicle is the Ford F-150. And things should only improve, as about 20 percent of millennials polled said that their next car would probably be an EV. The results are all the more encouraging, at least among green-car advocates, because gas prices have fallen about 40 percent within the past five years, meaning that there's less of an incentive to go electric from a purely economic perspective. Through the first quarter of this year, US plug-in vehicle sales were up about 63 percent from a year earlier to about 39,000 vehicles. Meanwhile, when it came to AAA's annual green-vehicle awards for this year, Tesla's Model S and Model X took the large car and SUV categories, respectively, while the Chevrolet Bolt and Volkswagen e-Golf were listed atop the subcompact and compact lists. US prepares to sue Fiat Chrysler over diesel emissions testing

NEW YORK - The Justice Department plans to file a civil lawsuit against Fiat Chrysler Automobiles NV over excess diesel emissions as early as this week if no agreement is reached with the Italian-American automaker, two sources briefed on the matter said on Wednesday. The Environmental Protection Agency in January accused FCA of illegally using undisclosed software to allow excess diesel emissions in about 104,000 cars and SUVs, the result of a probe that stemmed from regulators' investigation of rival Volkswagen AG. The EPA and California Air Resources Board have been in talks with FCA about the excess emissions and whether the agencies would approve the sale of 2017 FCA diesel models. A federal judge in California has set a May 24 hearing on a series of lawsuits filed by owners of vehicles against Fiat Chrysler and the Justice Department is expected to file its action by then if no agreement is reached. FCA said on Wednesday it believed that any litigation would be "counterproductive" to ongoing discussions with the EPA and California Air Resources Board. The company added that "in the case of any litigation, FCA US will defend itself vigorously, particularly against any claims that the company deliberately installed defeat devices to cheat U.S. emissions tests." The Justice Department took the same procedural step in early 2016 against Volkswagen, nearly four months after the German company admitted using software to emit excess diesel emissions in nearly 500,000 vehicles. The Justice Department has had an ongoing criminal investigation into FCA's conduct since last year, Reuters reported in January. The probe has turned up internal emails written in Italian and other documents about engine development and emissions issues, sources briefed on the probe said. U.S. regulators said FCA failed to disclose engine management software in 104,000 U.S. 2014-2016 Jeep Grand Cherokees and Dodge Ram 1500 trucks with 3.0-liter diesel engines. The European Commission has launched legal action against Italy for failing to respond to allegations of emission-test cheating by Fiat Chrysler in a procedure that could lead to the country being taken to court. The EPA has said the maximum possible fine against FCA could be $4.6 billion. In February, FCA said it had received requests for information and subpoenas from U.S. federal and state authorities, including the Securities and Exchange Commission, for diesel issues.
