Former Porsche execs acquitted of stock manipulation charges

A German court acquitted former Porsche CEO Wendelin Wiedeking and former CFO Holger Harter of stock manipulation charges, according to Bloomberg. Prosecutors alleged the men hid plans to takeover Volkswagen while publicly denying their intentions to investors. The presiding judge didn't find any merit to those claims, though. "There is nothing to the allegations, absolutely nothing," Judge Frank Maurer said, according to Bloomberg. "There was no secret plan to take over VW." Rather than Porsche taking over VW, the exact opposite eventually happened, and both execs stepped down. Investigators first indicted Wiedeking and Harter for alleged stock manipulation in late 2012. A court in Stuttgart dismissed the case in 2014 because of a lack of evidence, but an appeals court later overruled that decision. The current trial finally began in October 2015. If convicted, Wiedeking faced up to 30 months in prison, and Harter could have received up to 27 months, Bloomberg reported. Prosecutors also wanted one million euro ($1.1 million) fines from them and 807 million euros ($910 million) from Porsche. The acquittal might not be the end of this long-running case, though. In Germany, prosecutors have the right to appeal a ruling, and the lawyer hasn't made a final decision yet. If the court thinks there's a reason, the former execs could be back in front of a judge at some point in the future.

Volkswagen's ongoing diesel scandal is turning out to be an expensive problem for the German automaker. With a recent settlement expected to cost the company up to $14.7 billion, the company is scrambling to find ways to save cash. In light of this, Audi could be pulling out of the highest class of endurance racing, which it has dominated for years. A report from Germany's Auto Motor und Sport, indicates that Audi has already finalized the automaker's departure from the World Endurance Championship's top-tier LMP1 class after the 2017 season. Another report by Autocar cites an unnamed insider to corroborate the LMP1 exit rumors. The report fingers the VW Group's ongoing diesel scandal's financial fallout as the main culprit for Audi bowing out of LMP1. The move to could also be due to the group's decision to move away from diesel technology. Audi's LMP1 car, the R18, utilizes a V6 turbo-diesel engine. The Porsche 919 Hybrid, on the other hand, uses 2.0-liter turbocharged V4 engine that runs on gasoline. Audi has won the legendary 24 Hours of Le Mans 13 times since 1999, making Audi an unstoppable force in endurance racing. Porsche, Audi's corporate sibling, reentered endurance racing with a LMP1 competitor of its own in 2014 and won the constructor's championship last year. Audi's decision to leave LMP1 could give Porsche a shot at creating its own Le Mans-winning dynasty. Autocar reports that Audi is expected to continue fielding cars in other WEC classes, like GT3 and GT4, and perhaps the brand will even enter Formula E. We reached out to Audi for some clarification on the matter and a spokesperson stated that the rumors were "pure speculation at this point." VW air rule violation allegations 'stunning,' $18B fine unlikely

The big automotive news today was the US federal allegations that VW quietly and illegally installed software on approximately 482,000 diesel vehicles sold in the United States so that they would not return substandard results on government emissions tests. To say the least, this is potentially a very big deal. You can read the details of the government's allegations here. The problem seems to be with the NOx trap. Sam Abuelsamid, a former AutoblogGreen editor who is now a senior research analyst at Navigant Research's Transportation Efficiencies program, told me that there were some hints that VW's diesel emissions strategy had issues a while back. The vehicles affected by today's announcement are all equipped with the 2-liter, 4-cylinder TDI, he said. They all have the lean NOx (nitrogen oxides) trap, whereas all other current modern diesels use urea to treat NOx emissions. "When VW launched those vehicles, I went to the TDI launch program in Santa Monica and asked them if they were going to put the diesel engine into the Tiguan because that would be an ideal application," he said. "They said no, because it would be too heavy. Turns out, the NOx trap was enough to meet the emissions standards in the smaller cars, but not the Tiguan. That seems to be where the problem is, in the NOx trap. All the other big VW and Audi diesels, they use urea, just like BMW and Mercedes do." Abuelsamid added that, in California, to do an emissions test, testers don't stick a probe up the exhaust, as you would suspect. Instead, they just do a visual test to make sure nothing was tampered with and then plug a scanner into the OBD-II port to read the codes. The news today basically says that the cars were programmed to send out false codes, giving readings that testers are looking for instead of what's actually going on. "That's the background, as far as I know at this point," he said. This could be "a black eye on the auto industry." - John O'Dell Speaking at the AltCar Expo in Santa Monica just hours after the news first broke this morning, Edmunds.com's John O'Dell said the Fed's allegations were "stunning." The idea that VW might have gamed the system, he said, "underscores how important EPA clean air numbers are, that a company would allegedly stoop to this to try and meet them. Obviously, people are paying attention to that sort of thing.
