German judge 'inclined to dismiss' hedge fund lawsuit against Porsche

Last year, around two dozen investors, including hedge funds, leveled a 1.4 billion euro ($1.95 billion at the time) lawsuit against Porsche in connection with the automaker's attempted takeover of Volkswagen in 2008. The Stuttgart Regional Court dismissed the case. Around 19 of those plaintiffs are heading back to court to appeal the ruling and still hope to get 1.2 billion euros ($1.4 billion). However, according to one German judge, the chances for success aren't any better this time around. "On balance it's our view that we consider the lawsuit, or the appeal, to be unpromising for several reasons," Gerhard Ruf, a judge in Stuttgart, said to Reuters. "We are inclined to dismiss the case." The court's ruling on the appeal will be announced on March 26. The investors' case hinges on Porsche's strategy surrounding the botched takeover. The sports car maker said that it wasn't trying to control VW, when in fact it was. These hedge funds had bet against Volkswagen stock, but the share price surged when Porsche's plan inevitably came to light. Investors have sued the sports car company multiple times since then in attempts to recoup billions of dollars. However, none of the lawsuits have been successful, whether attempted in the US or Germany. Former Porsche CEO Wendelin Wiedeking and and CFO Holger Haerter might still stand trial for the alleged stock manipulation, though. New Audi design chief Massimo Frascella shaped cars for Jaguar Land Rover

At the Audi brand, style and design have long been a high priority; think the super sleek and sexy A7 sedan, the Bauhaus-inspired TT coupe, the single-frame grille that instantly identified the marque with its down-the-road graphics. So when the Bavarians install a new head of design, that’s also worth a look. Massimo Frascella is that person, a 52-year-old Italian designer who this summer will succeed Marc Lichte. Lichte ran Audi design since 2014 and will take up a new role within the Volkswagen Group. Frascella, a student at the Istituto d`Arte Applicata & Design in Turin, ignited his career at Stile Bertone, and his resume after that evolves impressively. He subsequently held positions at Ford Motor Company and Kia, and since 2011, Frascella has held senior positions at Jaguar Land Rover. He was responsible for the creation of several models: Discovery Vision Concept (2014), Discovery Sport (2014), Discovery (2016), Velar (2017), Evoque (2019) and Defender. In 2019 he became creative director of Land Rover and in 2020 design director. He was also instrumental in the development of the range of new electric Jaguars that are in the works. “Joining Audi is a very special moment for me,” Frascella said. “I am deeply honored to assume the role of chief creative officer and to guide such a talented team in shaping the future of the brand to new heights of innovation and distinction. De Silva was appointed head of Audi design in 2002. From 2007 to 2015, he supervised the design strategy for the entire Volkswagen group, including the TT, the Scirocco, the Passat and the Golf. VW will reportedly offer cash to cheated diesel car drivers

If you're feeling burned by Volkswagen's decision to cheat on diesel emissions tests, you might get some compensation for your troubles. Sources for The Truth About Cars understand that VW will launch a "TDI Goodwill Program" that compensates diesel car drivers with cash in the form of prepaid cards. In the US, you'd get both a $500 universal card as well as a VW-only card worth $500 to $750. The automaker isn't confirming details just yet, but it tells the New York Times that it's planning an announcement on Monday. Dealers also tell the newspaper that they're aware of a program in the works, although they don't know the specifics. It may not include the expanded range of cars reportedly tainted by the scandal, though, since VW is denying claims that it cheated with some models. This isn't the only olive branch VW has been offering: it's been handing out deals to existing owners willing to hop into new vehicles, and there are more discounts than usual across the board. However, the goodwill effort would represent the first instance of VW directly compensating drivers who'd previously thought they were getting an eco-friendly machine. This isn't going to make up for years of unnecessary pollution, but it may represent the company's best hope of holding on to customers.
