US prepares to sue Fiat Chrysler over diesel emissions testing

NEW YORK - The Justice Department plans to file a civil lawsuit against Fiat Chrysler Automobiles NV over excess diesel emissions as early as this week if no agreement is reached with the Italian-American automaker, two sources briefed on the matter said on Wednesday. The Environmental Protection Agency in January accused FCA of illegally using undisclosed software to allow excess diesel emissions in about 104,000 cars and SUVs, the result of a probe that stemmed from regulators' investigation of rival Volkswagen AG. The EPA and California Air Resources Board have been in talks with FCA about the excess emissions and whether the agencies would approve the sale of 2017 FCA diesel models. A federal judge in California has set a May 24 hearing on a series of lawsuits filed by owners of vehicles against Fiat Chrysler and the Justice Department is expected to file its action by then if no agreement is reached. FCA said on Wednesday it believed that any litigation would be "counterproductive" to ongoing discussions with the EPA and California Air Resources Board. The company added that "in the case of any litigation, FCA US will defend itself vigorously, particularly against any claims that the company deliberately installed defeat devices to cheat U.S. emissions tests." The Justice Department took the same procedural step in early 2016 against Volkswagen, nearly four months after the German company admitted using software to emit excess diesel emissions in nearly 500,000 vehicles. The Justice Department has had an ongoing criminal investigation into FCA's conduct since last year, Reuters reported in January. The probe has turned up internal emails written in Italian and other documents about engine development and emissions issues, sources briefed on the probe said. U.S. regulators said FCA failed to disclose engine management software in 104,000 U.S. 2014-2016 Jeep Grand Cherokees and Dodge Ram 1500 trucks with 3.0-liter diesel engines. The European Commission has launched legal action against Italy for failing to respond to allegations of emission-test cheating by Fiat Chrysler in a procedure that could lead to the country being taken to court. The EPA has said the maximum possible fine against FCA could be $4.6 billion. In February, FCA said it had received requests for information and subpoenas from U.S. federal and state authorities, including the Securities and Exchange Commission, for diesel issues.

Toyota is recalling 7,600 Prius vehicles for an airbag issue. Certain examples of the 2016 Prius could have malfunctioning inflators that could cause the passenger side airbags to deploy accidentally. There are no known injuries from the faulty airbags, but Toyota says, "This has been observed when the vehicle is parked and unoccupied for a period of time." Peugeot is adding another e-bike to its portfolio with the eU01s. What sets this electrically assisted bicycle apart from both regular bikes and other pedelecs is its ability to propel the bike to 28 mph under electric power. It comes with either a 400- or 500-Wh lithium-ion battery, providing 47 or 59 miles of range, respectively. It also offers an optional on-board computer with its 4.3-inch screen, through which riders can customize the electric assistance, get directions, receive sports coaching, and connect their smartphone. In the second of three phases for the plant, BYD is adding onto its factory in Lancaster, California, where it currently builds electric buses. The Chinese company plans to triple the number of employees, up from the current 400, as it expands the facility by 40,000 square feet. The German states of Hesse and Baden-Wuerttemberg are suing Volkswagen over the Dieselgate scandal. The states are joining other investors seeking damages over losses incurred because of the automaker's emissions cheat device. Hesse Finance Minister Thomas Schaefer said the scandal cost the state about $4.4 million in stock losses, while Baden-Wuerttemberg likely lost closer to $450,000. You might think that after driving a Dodge Challenger Hellcat during the week of the Woodward Dream Cruise, seven days with a diesel-powered Volkswagen Golf SportWagen would be a letdown. You know, like following a shot of Jack Daniels with a sippy cup of Metamucil. But it ended up being perfect timing. Right at the end of my Challenger loan, I signed my name what felt like 1,241 times, handed over a very, very large check, and officially bought my first home. The SportWagen arrived on moving day, and I set about putting the longroof's hauling ability to the ultimate test, schlepping everything I own to my very first house. SportWagens, like Metamucil, can often be very good for you. The wagon's cargo area isn't dramatically bigger than the standard Golf – 30.4 cubic feet versus 22.8 – unless you fold the second row down. With the seats flat, the Golf SportWagen's advantage nearly doubles, to 66.5 cubic feet. But it's not just the extra space that makes moving things a lot easier. The rear hatch is more defined and sits atop a lower bumper. The load height is just 24.8 inches, while the tailgate opens to an aperture of 40.6 inches. In short, loading stuff into the back was a breeze. While you might expect the Golf SportWagen to make short work of a bunch of boxes, it was easy to add larger items into the mix. I hauled nightstands, a large desk chair, and even all four pieces of a king-size IKEA bed frame with a minimal amount of fuss. That said, Volkswagen uses nice materials in the cargo compartment of the Golf, so if you frequently move a lot of stuff, expect to see visible wear sooner rather than later. If you prefer to move people instead of things, rest easy knowing the wagon mimics the Golf hatchback's 35.6 inches of rear legroom. Moving locally meant a lot of back-and-forth trips. Between the actual move itself and the subsequent running around, I put 600 miles on the Golf SportWagen during my week-long loan. But with this car, I could have done way more and wouldn't have found cause to complain. It's the little details that make the Golf feel premium. The Golf's cabin is a great place to be.
