Angry diesel owners joining lawsuits against Volkswagen [w/video]

Livid at the prospect of losing thousands of dollars from the value of their cars and performance from their diesel engines, many owners of Volkswagens are headed to court. A law firm with a track record of suing automakers has already filed three class-action lawsuits against the German automaker related to its emissions-cheating scandal and says a fourth one is on the way. The lawsuits, filed by national firm Hagens Berman, accuse Volkswagen Group of America of fraudulent concealment, false advertising, and violations of federal and state laws. Plaintiffs in all 50 states have joined the class-action suits, according to the firm. A spokesperson says there has been "an unprecedented response" since the first lawsuit was filed within hours of an announcement from federal regulators last Friday. The lawsuits accuse Volkswagen Group of America of fraudulent concealment, false advertising, and violations of federal and state laws. Diesel owners paid thousands more for their vehicles instead of their gasoline-powered counterparts because Volkswagen's diesel engines ostensibly offered both torque and fuel economy. Now affected car owners are faced with a double-whammy – the value of their cars has diminished with the news and the purported software fix that brings the cars in emissions compliance will likely lower their performance and gas mileage. "Hundreds of thousands of consumers put their trust in VW when they looked to its 'Clean Diesel' line for an efficient, environmentally conscious diesel option," said Steve Berman, managing partner. "But for years, VW cheated the system. Its TDI line of fast but 'good-for-the-environment' cars seemed too good to be true, and they were." In its latest court filing, Hagens Berman lawyers said that car owners believed their vehicles were in compliance with Environmental Protection Agency standards and that the cars would retain their operating characteristics throughout their useful lives. Another firm, Girard Gibbs, has also filed a lawsuit over the diesel deception. "These Volkswagen vehicles should never have been sold, and certainly should not have spent the past six years on American roads polluting our air," said Eric Gibbs, the lead attorney. "Not only does this kind of fraud harm consumers and the environment, it negatively impacts competition, which is what drives our free-market system.

German investigators search VW headquarters, take documents

German investigators are no longer pursuing an official investigation against former Volkswagen CEO Martin Winterkorn, but prosecutors aren't giving up their detective work into the automaker's actions surrounding its diesel emissions scandal. In their latest move, authorities have searched VW's headquarters in Wolfsburg and confiscated documents and other data to learn more about how a software-based "defeat device" made it into the real world, according to Reuters. VW described the amount of material that it handed over as "comprehensive." The automaker is also conducting its own, internal investigation, but the company isn't releasing those results, yet. It has allegedly responded by suspending over 10 employees, including three top engineers. There has been reportedly no actual evidence found against this trio of men. In addition to the work of German prosecutors, many US investigators are looking into VW's actions, as well. The West Virginia Attorney General is suing the company for fraud, and there are pending class-action lawsuits. In written testimony for a Congressional hearing, Michael Horn, President and CEO of VW Group of America, said he first learned of the emissions noncompliance when the West Virginia University study was published in the spring of 2014. A recall on the affected Volkswagens isn't expected to begin until at least January, according to CEO Matthias Muller, and it could be later for some models. The costs to fix them all and deal with potential fines means that VW must delay some projects to save money. Put another way, VW will be dealing with the repercussions of this scandal for years. But if the Alltrack was one that you wished would make the transatlantic voyage to US showrooms, we've got good news for you, because VW has confirmed its bringing the Golf SportWagen Alltrack to America. Revealed last year at the Paris Auto Show, the Golf SportWagen Alltrack is VW's answer to a Volvo Cross Country or Subaru Outback. It starts with the Golf SportWagen, which already offers more space than a standard Golf hatch, but adds to it a higher ride height, lower body cladding, a new front bumper and upgraded cabin space. It also crucially gets 4Motion all-wheel drive, something which was previously available only on the top-of-the-line Golf R. The Haldex 5-based system sends power to the front wheels under normal conditions, but can divert up to 50 percent to the back in slippery situations. VW has yet to confirm just which engine and transmission combinations will be offered in the US-spec Alltrack, but it's offered overseas in four flavors: a gasoline-burning turbo four with 178 horsepower and a trio of diesels ranging in output from 109 hp to 182. The US-spec Golf hatch is offered with either a turbo four or a mid-range TDI before getting into the GTI, Golf R and e-Golf alternatives. The German automaker hasn't confirmed exactly when the first examples are set to hit US showrooms, but they're slated for sometime next year.
