VW diesel incentives could be fuel for prosecutors

In the 2000s, Volkswagen was among the companies that lobbied the government to get buyers of diesel vehicles a tax credit. The automaker even brought some of these models to Washington to show them to politicians. The incentive eventually passed, and about 39,500 customers of the 2009 Jetta TDI and Jetta SportWagen TDI got a $1,300 benefit – for a total cost of around $51 million. Now, according to Reuters, that politicking might come back to bite the automaker when prosecutors finally get cases to trial. The US Department of Justice, the Environmental Protection Agency, and attorneys general in at least 29 states are already investigating VW, and politicians are pushing for criminal and civil actions against the company. According to Reuters, there could be several legal routes available, too. One option is to bring tax fraud charges, and that would require proving the automaker knew it was making untrue claims about the diesel models. There's also the option of bringing a case under the False Claims Act, which prohibits fraud against the government. According to Reuters, a maximum penalty under the law would be three times the tax credit and another $5,000 for each vehicle that received it. The company is also facing a class-action lawsuit from disgruntled owners. To aid its defense against all of these claims, VW has hired the same firm that worked with BP during the Deepwater Horizon oil spill. Outside of the US, prosecutors in Germany have just started to build a case against former CEO Martin Winterkorn for alleged fraud. In addition to these potential legal penalties, VW could be fined around $18 billion by the EPA for the emissions infractions. The agency's investigation is getting the added backing of its Canadian counterpart. Although, the actual settlement is expected to be far less.

Volkswagen to 'refit' 11 million diesel vehicles [UPDATE]

UPDATE: This post has been updated with an official comment from Volkswagen of America. In response to its devastating diesel-emissions scandal, Volkswagen will ask some 11 million of its customers to report into dealerships to have their diesel-powered vehicles "refitted," Reuters is reporting. According to new CEO Matthais Muller, customers will be asked to report in "in the next few days" for the refit, although it's not entirely clear exactly what the 'refit' entails. Mueller apparently made the announcement during a closed-door meeting with 1,000 of the German company's top managers, although he didn't explain exactly how the emissions-cheating software would be sorted out, or what impact it would have on the performance of mileage of the company's diesel-powered products. It's expected that the refit work will cost VW $6.5 billion, Reuters claims. "We are facing a long trudge and a lot of hard work," Muller allegedly said. "We will only be able to make progress in steps and there will be setbacks." Autoblog reached out to Volkswagen of America to see when American consumers would be asked to report to dealers, what the refit involves, how long it's expected to take to repair all the cars in the US and globally, and what impact this fix will have on the performance and fuel economy of its diesel-powered cars and SUVs. Unfortunately and unsurprisingly, VWoA wasn't too forthcoming. "We don't comment on media speculation on internal meetings," Volkswagen of America spokesman Mark Gillies told Autoblog, adding, "We don't have any information on what the remedy might be at the moment, but we are working on it as a matter of the utmost urgency."

Volkswagen Golf, Ford F-150 named 2015 North American Car and Truck/Utility of the Year

Congratulations, Volkswagen Golf/GTI and Ford F-150. You've just been named the 2015 North American Car and Truck/Utility of the Year, kicking off the first press day of the Detroit Auto Show. The Golf faced some seriously stiff competition from its runners-up, the Ford Mustang and Hyundai Genesis. But the Golf has been a highly awarded vehicle since its launch, including recently being named Motor Trend's Car of the Year. As for the Truck/Utility award, it wasn't immediately clear that the aluminum-bodied Ford F-150 would win the North American honor, topping the Chevrolet Colorado and Lincoln MKC. The Chevy, after all, has been widely praised since arriving this fall, including taking home MT's Truck of the Year award. In 2014, Chevrolet had a sweep of the NACTOY awards, with the Corvette Stingray and Silverado taking top honors.
