Winterkorn not under official investigation in Germany

Prosecutors for the state of Lower Saxony in Braunschweig, Germany, are now saying that former Volkswagen CEO Martin Winterkorn is no longer specifically under investigation for his role in alleged fraud related to the automaker's diesel emissions scandal. The lawyers are clarifying that there's no formal inquiry into the exec because there's not yet enough evidence to establish a suspicion of wrongdoing, Bloomberg reports. However, they are still looking into VW's actions. Earlier this week, the prosecutors announced they had begun an initial investigation into Winterkorn for alleged fraud in the emissions regulation evasion. At that time, there were reportedly 12 complaints asking the lawyers to look into the case, including one from VW. Under German law, only a person could be charged for the potential crimes, rather than a whole company. "An initial suspicion must be based on facts, and you must begin an investigation before you can establish the facts," Christoph Schalast, a professor at the Frankfurt School of Finance, said to Bloomberg. Meanwhile in the US, the investigation continues into VW. The Department of Justice has the support from at least two senators to pursue criminal and civil charges against the company. The attorneys general in at least 29 states are also looking into things. Meanwhile, lawyers are building a class-action lawsuit, as well. CARB found another emissions-defeating device, this time from Audi

The California Air Resources Board has discovered another emissions-cheating device on an Audi earlier this summer, reports German newspaper Bild am Sonntag. The device is different from the software found in the VW Group's diesel-powered engines, as it alters the way the cars' automatic transmission shifts. The latest device, according to Bild am Sonntag, measures how far the cars' steering wheel is being turned. If the wheel is turned less than 15 degrees, indicating that the vehicle is being tested in laboratory conditions, a program in cars with certain automatic transmissions changes the way the gearbox shifts. The change in the transmission allows the engine to produce less carbon dioxide than when driving in normal conditions. When the wheel is turned more than 15 degrees, the program automatically turns off, claims Bild am Sonntag. The paper reports that Audi took the software out of its vehicles, which was used in both diesel- and gasoline-powered vehicles in Europe and the US, earlier this May after CARB discovered the program on one of the automaker's older cars. Several engineers that were connected with the emissions-cheating device have already been suspended, reports Bild am Sonntag. As the German newspaper points out, the device, which is fitted to certain Audis with an automatic transmission, is different from the cheat devices found on the automaker's 3.0-liter TDI turbodiesel V6 engine and Volkswagen's 2.0-liter turbodiesel motor, even those were also designed to beat emissions tests. The 3.0-liter engine is found in the Audi Q7, Volkswagen Touareg, and Porsche Cayenne models. Audi didn't immediately respond to our request for a comment. Audi rumored to leave top-tier endurance racing after 2017

Volkswagen's ongoing diesel scandal is turning out to be an expensive problem for the German automaker. With a recent settlement expected to cost the company up to $14.7 billion, the company is scrambling to find ways to save cash. In light of this, Audi could be pulling out of the highest class of endurance racing, which it has dominated for years. A report from Germany's Auto Motor und Sport, indicates that Audi has already finalized the automaker's departure from the World Endurance Championship's top-tier LMP1 class after the 2017 season. Another report by Autocar cites an unnamed insider to corroborate the LMP1 exit rumors. The report fingers the VW Group's ongoing diesel scandal's financial fallout as the main culprit for Audi bowing out of LMP1. The move to could also be due to the group's decision to move away from diesel technology. Audi's LMP1 car, the R18, utilizes a V6 turbo-diesel engine. The Porsche 919 Hybrid, on the other hand, uses 2.0-liter turbocharged V4 engine that runs on gasoline. Audi has won the legendary 24 Hours of Le Mans 13 times since 1999, making Audi an unstoppable force in endurance racing. Porsche, Audi's corporate sibling, reentered endurance racing with a LMP1 competitor of its own in 2014 and won the constructor's championship last year. Audi's decision to leave LMP1 could give Porsche a shot at creating its own Le Mans-winning dynasty. Autocar reports that Audi is expected to continue fielding cars in other WEC classes, like GT3 and GT4, and perhaps the brand will even enter Formula E. We reached out to Audi for some clarification on the matter and a spokesperson stated that the rumors were "pure speculation at this point."
