French probe alleges 2 million PSA cars had engine cheats

PARIS — A French investigation into alleged emissions cheating by PSA Group found that suspect software had been used on almost 2 million vehicles sold by the maker of Peugeot and Citroen cars, Le Monde reported on Friday. Paris-based PSA denies any use of fraudulent engine software, a spokesman said in response to the newspaper report, which sent PSA shares sharply lower. The stock was down 4.4 percent at 17.78 euros as of 1019 GMT. So-called "defeat devices" restrict exhaust output of toxic nitrogen oxides (NOx) under regulatory test conditions while letting emissions far exceed legal limits in real-world driving. In February, PSA became the fourth carmaker to be referred to French prosecutors by the country's DGCCRF watchdog over suspected emissions test-cheating, after Volkswagen, Renault and Fiat Chrysler. PSA's engineering chief acknowledged at the time that emissions treatment in the group's diesels was deliberately reduced at higher temperatures to improve fuel efficiency and carbon dioxide (CO2) emissions in out-of-town driving, where NOx output is considered less critical. According to Le Monde, an internal PSA document obtained by DGCCRF investigators includes discussion of the need to "make the 'defeat device' aspect less obvious and visible." However PSA insists there is nothing fraudulent or illegal about its engine calibrations. "PSA denies any fraud and firmly reaffirms the pertinence of its technology decisions," the company said on Friday. Tanner Foust and Scott Speed get VW internships

Tanner Foust and Scott Speed both already have quite impressive motorsport resumes. The former is a rallycross and drifting champ, and the latter counts two years in Formula One with Toro Rosso among his accomplishments. Still, it's never too late for a career change. In a humorous new ad for Volkswagen, the professional racers take on the duties of summer interns at a dealership. The commercial is timed with the kickoff of the 2015 Global Rallycross Championship season in Fort Lauderdale, FL, on May 30 and 31. Speed and Foust are both racing in Beetle GRCs for the Volkswagen Andretti Rallycross team. This year's Bug is even more potent than last year, though. It now packs a 2.0-liter turbocharged four-cylinder engine to produce 553 horsepower and 465 pound-feet of torque, versus the previous 1.6-liter turbo four with to 544 hp and 387 lb-ft. The racer can reportedly hit 60 miles per hour in just two seconds thanks in part to low gearing and all-wheel drive. One of the Andretti team Beetles might look a little different, too. Foust is sticking with his Rockstar Energy Drink sponsorship, but Speed gets an animalistic livery for Shark Week to celebrate the annual event from the Discovery Channel. SCOTT SPEED TO RACE SHARK WEEK THEMED BEETLE GRC IN RED BULL GLOBAL RALLYCROSS SEASON OPENER Scott Speed and Tanner Foust will contest the Red Bull Global Rallycross Championship in Beetle GRCs, starting this weekend in Fort Lauderdale Herndon, VA — The Volkswagen Andretti Rallycross team begins its second full season of racing this weekend in Ft. Lauderdale. The team will again be battling with two Beetle GRC race cars, which debuted in the closing races of 2014. As Volkswagen enters its fourth consecutive year as a presenting sponsor of Discovery Channel's SHARK WEEK, Scott Speed will concurrently begin the Red Bull Global Rallycross season behind the wheel of the No. 41 SHARK WEEK Volkswagen Beetle GRC, wrapped for SHARK WEEK, which begins on July 5th. "My father raced with No. 41 in karts when I was younger so it's pretty special to me," said Speed. "I have only had the option to choose the No. 41 twice in my career and was able to win championships each time. Hopefully it continues to bring me luck in 2015!" New this year, the team has chosen to change the engine specification from the Beetle GRC race cars that ran in 2014.

$1.4B hedge fund suit against Porsche dismissed

Investors have canvassed courts in Europe and the US to repeatedly sue Porsche over its failed attempt to take over Volkswagen in 2008 (see here, and here and here), and they have repeatedly failed to win any cases. You can add another big loss to the tally, with Bloomberg reporting that the Stuttgart Regional Court has dismissed a 1.4-billion euro ($1.95B US) lawsuit, the decision explained by the court's assertion that the investors would have lost on their short bets even if Porsche hadn't misled them.
Examining the hedge funds' motives for stock purchases and the bets that VW share prices would fall, judge Carola Wittig said that the funds didn't base their decisions on the key bits of "misinformation," and instead were participating simply in "highly speculative and naked short selling," only to get caught out.
With other cases still pending, the continued streak of victories bodes well for Porsche's courtroom fortunes, since judges will expect new information to consider overturning precedent. If there is any new info, it could come from the potential criminal cases still outstanding against former CEO Wendelin Wiedeking and CFO Holger Härter, who were both indicted on charges of market manipulation.
