German judge 'inclined to dismiss' hedge fund lawsuit against Porsche

Fri, Feb 27 2015

Last year, around two dozen investors, including hedge funds, leveled a 1.4 billion euro ($1.95 billion at the time) lawsuit against Porsche in connection with the automaker's attempted takeover of Volkswagen in 2008. The Stuttgart Regional Court dismissed the case. Around 19 of those plaintiffs are heading back to court to appeal the ruling and still hope to get 1.2 billion euros ($1.4 billion). However, according to one German judge, the chances for success aren't any better this time around. "On balance it's our view that we consider the lawsuit, or the appeal, to be unpromising for several reasons," Gerhard Ruf, a judge in Stuttgart, said to Reuters. "We are inclined to dismiss the case." The court's ruling on the appeal will be announced on March 26. The investors' case hinges on Porsche's strategy surrounding the botched takeover. The sports car maker said that it wasn't trying to control VW, when in fact it was. These hedge funds had bet against Volkswagen stock, but the share price surged when Porsche's plan inevitably came to light. Investors have sued the sports car company multiple times since then in attempts to recoup billions of dollars. However, none of the lawsuits have been successful, whether attempted in the US or Germany. Former Porsche CEO Wendelin Wiedeking and and CFO Holger Haerter might still stand trial for the alleged stock manipulation, though. VW has received several tentative bids for Ducati

Thu, Jul 20 2017

Italy's Benetton family is vying with motorbike firms and buyout funds for control of Italian motorcycle brand Ducati, which is being sold by Germany's Volkswagen, sources involved in the process told Reuters. Volkswagen, whose Audi division controls Ducati, has received several tentative bids with the Benetton family's investment vehicle Edizione Holding valuing the Monster motorbike maker at $1.2 billion, one of the sources said. As well as Edizione Holding, U.S. buyout fund Bain Capital, which owns a stake in Ski-Doo snowmobiles maker BRB, and two Indian motorbike firms, Eicher Motors and Bajaj Auto, have also bid for Ducati, the sources said. Indian carmaker Eicher controls Royal Enfield, a motorcycle brand established in 1893 which ranks as one of the oldest. Strategic bidders also include U.S. automotive firm Polaris Industries, which earlier this year said it would wind down its struggling Victory Motorcycle brand. A shortlist of bidders for a second stage of the auction could be selected as soon as Saturday, two of the sources said. Volkswagen adviser Evercore has a long list of bidders including private equity funds such as Ducati's previous owner Investindustrial, CVC Capital Partners, Advent and PAI, all hoping to outbid industry players, the sources said. If it gets to the second round, Edizione Holding could seek to form a consortium with a financial investor, two of the sources said, in a bid to secure control of Ducati, whose racers have won the Superbike world championship 14 times, with Carl Fogarty and Troy Bayliss its most successful riders. Audi, Edizione Holding, Investindustrial, Advent and PAI declined to comment, while the other interested groups were not immediately available for comment. PRICING CHALLENGES For some buyout funds, Ducati's valuation of up to $1.4 billion – which sources said is based on a multiple of more than 10 times its core earnings of roughly 100 million euros – is a tall order as they lack the synergies that some motorbike makers could achieve. But Investindustrial founder Andrea Bonomi, who sold Ducati to Audi for about 860 million euros in 2012, is serious about a comeback, one of the sources said. China's Loncin Motor was among a group of industry players that initially showed interest in Ducati, alongside Harley-Davidson. The latter has, however, decided against making a bid due to Ducati's price tag, while it could not be established if Loncin Motor had carried on bidding.

2015 Volkswagen Golf: Green Car of the Year?

Wed, Apr 1 2015

As you may recall, VW's compact Golf was voted 2015 North American Car of the Year by a jury of 57 veteran automotive journalists (including this one) and named Car of the Year by Motor Trend and Yahoo Autos and Best Car to Buy 2015 by Green Car Reports. "The range of green options in the 2015 Volkswagen Golf range is hard to beat," says Green Car Reports editor John Voelcker. "With more fuel-efficient gasoline engines, a new TDI diesel option that comes close to real-world hybrid mileage levels, and the all-electric VW e-Golf, the 2015 Golf gives buyers a good-better-best menu of options for driving green." The car was also a finalist for Green Car Journal's "Green Car of the Year," but ultimately lost to the BMW i3 EV. When I saw GCJ editor Ron Cogan at last November's Los Angeles Auto Show, he asked me to guess which finalist would win. Based on its efficiency and versatility, I guessed the Golf. He smiled but the next day, he named the i3 the winner. Okay, the technically impressive, carbon-fiber-bodied i3 is a formidable green machine wearing a prestige German label at a semi-affordable ($43,000) price. But it comes in just one (somewhat odd-looking) body style with a choice of all-electric or range-extending electric powertrains, and its EPA-official ranges are 81 miles for the former and just 150 for the latter, costlier version, which totes a tiny (647cc) 34-hp two-cylinder BMW motorbike engine in its tail. By contrast, the 2015 Golf comes in 3- and 5-door hatchback and even more practical Sportwagen body styles and offers a wide range of eager yet fuel-thrifty turbocharged gas and clean-diesel engines, most with a choice of manual or automatic transmission. An all-electric e-Golf, one of the best EVs we've yet driven, is also available in some areas, and that will be followed, VW says, by a hybrid, a plug-in hybrid and even a CNG-powered model. No question this all-new seventh-generation 2015 VW Golf is easily the best ever. A bit larger, roomier, aerodynamically slicker and more fuel efficient than the Gen VI Golf it replaces, it's built on an all-new modular platform and boasts an amazing range of models, powertrains and features.
