VW recognizes second union at Chattanooga plant

The ongoing story of organizing workers at Volkswagen's factory in Chattanooga, TN, continues to get more complicated. Following an independent audit, the automaker has now recognized a second union at the plant called the American Council of Employees. The group was founded there last year to offer an alternative to the United Auto Workers. "I'm not anti-union. I understand that a properly run union can benefit people. We will be that union," Sean Moss, president of the ACE, said to Reuters, according to Automotive News. The group claims to represent at least 15 percent of the workers at the plant. Acceptance of the ACE has led to an interesting situation in Chattanooga because VW also recognized the UAW at the factory in December 2014, and the group has claimed to represent at least 45 percent of workers there. According to Automotive News, each union has access to management, but the UAW has more because of its larger contingent of supporters. However, neither organization has a collective bargaining agreement with the automaker. Moss may have a rough time increasing support among employees at the factory. According to Automotive News, many anti-UAW workers there are completely against unions in general. Getting these folks to join his group isn't an easy task. The UAW has been working to fully represent the VW factory for years. However, the group lost a vote to do so in 2014. It eventually created a union local there to try to build support. All of the effort comes ahead of a $900 million plant expansion to add about 2,000 jobs and build a new crossover in Tennessee. VW diesel incentives could be fuel for prosecutors

In the 2000s, Volkswagen was among the companies that lobbied the government to get buyers of diesel vehicles a tax credit. The automaker even brought some of these models to Washington to show them to politicians. The incentive eventually passed, and about 39,500 customers of the 2009 Jetta TDI and Jetta SportWagen TDI got a $1,300 benefit – for a total cost of around $51 million. Now, according to Reuters, that politicking might come back to bite the automaker when prosecutors finally get cases to trial. The US Department of Justice, the Environmental Protection Agency, and attorneys general in at least 29 states are already investigating VW, and politicians are pushing for criminal and civil actions against the company. According to Reuters, there could be several legal routes available, too. One option is to bring tax fraud charges, and that would require proving the automaker knew it was making untrue claims about the diesel models. There's also the option of bringing a case under the False Claims Act, which prohibits fraud against the government. According to Reuters, a maximum penalty under the law would be three times the tax credit and another $5,000 for each vehicle that received it. The company is also facing a class-action lawsuit from disgruntled owners. To aid its defense against all of these claims, VW has hired the same firm that worked with BP during the Deepwater Horizon oil spill. Outside of the US, prosecutors in Germany have just started to build a case against former CEO Martin Winterkorn for alleged fraud. In addition to these potential legal penalties, VW could be fined around $18 billion by the EPA for the emissions infractions. The agency's investigation is getting the added backing of its Canadian counterpart. Although, the actual settlement is expected to be far less.

Volkswagen fans had to be pretty quick if they wanted to ensure their pre-order for one of the first 500 units of the 2015 Golf R to enter the US. The German brand opened the books online at at 12:01 AM EST, and according to company spokesperson Leigh Anne Sessions speaking to Autoblog, by around 10:30 AM EST all of them were snapped up. VW's pre-order page currently shows these vehicles as no longer available, and the company confirms the news on Twitter, as well.
