West Virginia sues VW for fraud, asks for major financial penalty

It took just four researchers, including two students, at West Virginia University doing some emissions tests eventually to engulf Volkswagen in an international scandal that has been raging for weeks. Now, the state's attorney general Patrick Morrisey has filed a formal complaint against the automaker's US branch for violating the West Virginia Consumer Credit and Protection Act. His argument alleges that VW "fraudulently manufactured, advertised, and sold" these polluting diesel vehicles as being good for the environment. If the West Virginia case is successful, VW could be on the hook for serious monetary punishment. Morrisey asks that any consumers in the state get refunds totaling the premium paid over a gasoline model, the loss in resale value, and the expected costs of lost performance from the upcoming recall repair. On top of that, the automaker would pay the state $5,000 for each violating vehicle and all of the related costs for preparing for the trial. According to the complaint's legal documents (here, as a PDF), the state's DMV currently shows 2,684, diesel 2009-2015 VW vehicles registered there. Morrisey isn't the only state attorney general to take a stern look at VW's actions, and his counterparts in at least 29 other states are investigation similar courses of action, as well. In addition, the Department of Justice and Environmental Protection Agency have their own probes underway. The final result could be very expensive for the automaker. (Volkswagen), alleging the business violated the West Virginia Consumer Credit and Protection Act. The complaint alleges that Volkswagen fraudulently manufactured, advertised and sold a line of "clean diesel" vehicles with Turbo-charged Direct Injection (TDI) engines. "Volkswagen allegedly knowingly engineered certain vehicles to cheat U.S. emissions tests," Attorney General Morrisey said. "That is one reason why we have filed this complaint." A May 2014 study conducted by the Center for Alternative Fuels, Engines & Emissions at West Virginia University found elevated levels of emissions on several Volkswagen cars. Their data was then turned over to the U.S. Environmental Protection Agency (EPA) and the California Air Resources Board.

EPA finally approves sales of 2017 BMW diesels

The Environmental Protection Agency has approved the sale of 2017 BMW diesel vehicles in the US, reports Automotive News. According to Chris Grundler, head of the EPA's Office of Air Quality and Transportation, the vehicles were delayed due to rigorous testing. Following the Volkswagen diesel scandal, the EPA stated that it would review all diesels headed to the US. Last month, the EPA delayed sales of BMW's 2017-model-year diesels due to testing logistics, claimed BMW. Now that the vehicles have been approved, production of the models should begin shortly. While BMW's diesels have been cleared, the report indicates that Mercedes-Benz's 2017 diesel models are still undergoing further testing. "Discussions continue," Grundler stated, but he declined to point to any specifics on why the EPA has not approved those diesel models. Amid the numerous lawsuits against VW, Mercedes has also been involved in suits that claim its diesels use defeat devices, although no major proof has surfaced. Earlier this year, Mercedes confirmed that the US Justice Department, EPA, and the California Air Resources Board (CARB), were investigating its diesel models. The 2016 diesel models from VW haven't been approved for sale yet, and the automaker has not asked for permission from the EPA to sell 2017 diesel models, claims Grundler. At this point in the year, it's not likely VW will sell any 2016 diesels. Last year, BMW's diesels accounted for about four percent of the company's total US sales, so the delay is not likely to have a drastic affect on its bottom line. 2015 Volkswagen Passat Alltrack ready for any road, except in the US

If Volkswagen built a Subaru Outback-fighter for US buyers, the Passat Alltrack would be it, and the new generation of VW's off-roading wagon debuted this week at the Geneva Motor Show. The Passat Alltrack – which is not sold in the United States – takes the car-like demeanor of the Passat and punches it up into a go-anywhere crossover. It has permanent 4Motion all-wheel drive, raised ride height and an electronic differential lock. The body is fitted with modified bumpers with underbody guards, reinforced wheelarches and side moldings with extended sills. There are roof rails on top, and it rolls on standard 17-inch wheels with 18s and 19s optional. The Passat Alltrack offers five direct-injected engines, with the lineup comprised of two turbocharged gasoline mills and three turbo diesels. Volkswagen loaded the vehicle with a wide range of infotainment and safety features, including choices of five radio and navigation units. It also has fully digital instruments, heads-up display and a rear-seat entertainment system setup for laptops. There is also lane-changing assist, rear-traffic alert and trailer-assist features. As spokesman confirmed to Autoblog there are no plans to bring the Passat Alltrack to the US market.
