Legal approach in $1.2 billion Toyota settlement could impact handling of GM recall cases

In the past, if an automaker did something wrong, they were usually prosecuted by the US government through something called the TREAD Act. Short for Transportation Recall Enhancement, Accountability and Documentation Act, it basically requires automakers to report recalls in other countries, along with any and all serious injuries or deaths, to the National Highway Traffic Safety Administration.
Failing to report or attempting to conceal anything when there's been a death or serious injury constitutes a criminal liability. The idea is that this setup puts the onus on manufacturers to keep NHTSA apprised of safety related issues before they become a problem in the US, thereby allowing the regulator to better protect consumers.
In theory, it sounds like a relatively airtight set of rules for dealing with misbehaving automakers. That didn't stop the US Department of Justice from ignoring TREAD in its prosecution of Toyota's handling of the unintended acceleration recall, though. The result of this new approach, which charged Toyota with wire fraud, was a $1.2 billion settlement. Now, the wire-fraud approach could be used for the expected case between the US government and General Motors, based on the statements of Attorney General Eric Holder, who specifically mentioned "similarly situated companies" when discussing Toyota.

Over the last three days, the Goodwood Estate has played home to the eponymous Festival of Speed. Thrown by the biggest gearhead in the British aristocracy – Charles Gordon-Lennox, the Earl of March and Kinrara – the Festival of Speed is essentially a tremendous, gasoline-fuelled party, complete with a very large lawn sculpture, that features the world's hottest, weirdest, fastest, and loudest race, production, and historic models. Watch as an unnamed driver wrestles the new Shelby GT350R and its flat-plane, 5.2-liter V8 up the hillclimb circuit. Even with the new suspension and sticky tires, this Mustang wants to go any direction but straight, especially following its launch. 2016 Ford Focus RS, Is Very Loud, Blue Ken Block makes his first appearance on our list. Before he steps into his Hoonicorn Mustang, though, the Gymkhana expert tackled the hill in the all-new Focus RS. The vicious bellow of the 2.3-liter, turbocharged four-cylinder is the star of this commentary-free video, although the gorgeous Nitrous Blue paint job is a nice accompaniment, as well. 1965 Ford Mustang Hoonicorn Runs Hill, Nearly Kills Lord March Mr. Block's two runs behind the wheel of the Hoonicorn were, unsurprisingly, very eventful. While one attempt goes off without a hitch, seeing the American rally driver slip and slide his way to the top of the hill while taking a short break for a donut, the other is slightly more dramatic. Block, along with Lord March in the passenger seat, carries a bit too aggressive an angle into a turn and nearly puts the NASCAR-powered Mustang into the hay bales. Despite the earnest efforts of Japanese automakers like Toyota and Nissan, the American pickup truck scene remains wholly dominated by the likes of Ford, General Motors and Chrysler. This is not news. Part of the reason is because of the sheer number of variants offered by US automakers - everything from work-spec base trucks to house-leveling heavy duty models can be had, with a seemingly endless combination of engines, cab sizes, bed lengths and trim levels. It's a hugely profitable business, and though the Japanese automakers still offer competitive fullsize trucks, in terms of sheer volume, they simply don't compete.
But American pickups aren't just about work; there's a huge play aspect involved, too. Look at the desert-storming Ford F-150 SVT Raptor or the Ram Power Wagon - these butch trucks are built with superb off-road prowess in mind, and Detroit's Japanese rivals have once again largely been silent in this segment. Until now.
Introduced at the 2014 Chicago Auto Show, Toyota now offers the TRD Pro series of models that, in addition to the crazy-orange Tundra seen here, includes the smaller Tacoma pickup and 4Runner SUV. And this isn't just some pretty appearance package, either - there's honest-to-goodness capability baked into all of the TRD Pro models. Intriguing, for sure, so I recently spent a weekend with the big boy Tundra to see what's what.
