Toyota nearing $1B settlement of unintended acceleration criminal probe

According to those all-too-nebulous "people familiar with the matter," Toyota is close to a settlement with the US federal government to end a criminal probe over its long-running unintended acceleration fiasco. Though Toyota has never admitted guilt, the deal could reportedly crest a billion dollars and would likely include a criminal deferred prosecution agreement, and while we're not legal experts, The Wall Street Journal explains that such a deal would "[force Toyota] to accept responsibility while avoiding the potentially crippling consequences of federal criminal convictions."
The report from WSJ also suggests that Toyota is facing charges that it "made false or incomplete disclosures" to various government agencies regarding possible defects to its cars. Such charges may include mail and wire fraud violations. Toyota has already paid out fines totaling $66.2 million to the National Highway Traffic Safety Administration because it failed to report safety defects in a timely manner.
This deal with the federal government is not related to the billion-dollar class-action settlement reached with Toyota owners over falling vehicle values, and it's also different from the roughly 400 lawsuits still in courts alleging personal injury of wrongful death due to cases of unintended acceleration. In other words, don't expect to hear the end of such courtroom verdicts and settlements anytime soon...

Toyota's Bob Carter says seat heater stop-sale due to inconsequential compliance error

Last week, Toyota let it be known that a number of its more-popular vehicles were subject to a "stop-sale" order due to faulty seat heaters on these vehicles. No injuries were reported, but the problem affected a lot of models, including the 2013 and 2014 Camry, Camry Hybrid, Avalon, Avalon Hybrid, Sienna, Corolla, Tacoma and Tundra. Toyota originally said 50,000 vehicles were involved, but Bob Carter, senior vice president of automotive operations for Toyota Motor Sales, knocked that down to 30,000 during an interview at the Chicago Auto Show this week and said that the problem is not going to have a big impact on Toyota's sales. "It's an important situation but it will have a very minor impact on February sales," he told AutoblogGreen. "Dealers will start receiving new heating elements this week and then we have a process to take out the heating element that was put in and exchange that for the new fabric. It's very simple. It's a quick repair." Quick in this situation means about three hours to swap out the heating elements in two seats, according to Toyota's John Hanson. Since the Avalon also has heated rear seats, that car will require a total of six hours in the shop. Hanson said there was no official timeline for when the exchange program would be completed, "but new vehicles are arriving at some dealerships with the new seat heaters already installed." With a fix already in place, Carter would not comment on whether a recall is likely, saying only, "I'm not the expert on that. We're working with the NHTSA and ultimately it's their decision. We believe it's an inconsequential compliance error that was made by one of our suppliers and we're going to correct it." Trucks, SUVs drive U.S. October new vehicle sales

DETROIT — Major automakers posted mixed U.S. new vehicle sales in October on Wednesday, though America's love affair with high-margin pickup trucks and SUVs remained in full bloom as larger, pricier vehicles fared better than passenger cars. Auto industry publication WardsAuto put the seasonally-adjusted annualized rate (SAAR) for light vehicle sales in October at a robust level of 18 million units. But after a long boom cycle, carmakers are still ill-prepared for the slight decline in sales anticipated for full-year 2017 and have taken too few steps to trim production, said Doug Mehl, a partner in consultancy A.T. Kearney's automotive practice. "When you make a new vehicle, you have volume assumptions tagged to it, and who wants to be the guy who says, 'I'm going to make less of this really cool model'?" Mehl said. "But eventually the market is the reality, and it's going to force companies one way or other here." General Motors GM reported a sales drop of 2.2 percent for the month, with consumer sales down 6.6 percent. But sales of high-margin pickup trucks, sport utility vehicles and crossovers all rose. GM also cut its inventory of unsold vehicles — a source of concern for the market — slightly. The automaker has worked to reduce its volume of excess inventory, including through significant production shutdowns in the third quarter. GM had said its inventory would rise in October. "We are heading into the fourth quarter with good momentum, thanks to a strong U.S. economy and very strong pickup and crossover sales," said Kurt McNeil, GM vice president for U.S. sales operations. GM slightly reduced consumer discounts as a percentage of average transaction prices to 13.5 percent, from 13.7 percent in the third quarter. Industry experts believe consumer discounts above 10 percent of the average transaction price are unhealthy as they erode resale values and are unsustainable in the long term. Consultants J.D. Power and LMC said last week that based on preliminary October sales numbers, discounts have exceeded 10 percent in 15 of the past 16 months. Ford The U.S. auto industry posted record sales of 17.55 million vehicles in 2016. New sales received a strong boost in September as consumers replaced vehicles damaged in southeast Texas by Hurricane Harvey the previous month. Full-year 2017 sales are expected to be slightly lower than 2016.
