Legal approach in $1.2 billion Toyota settlement could impact handling of GM recall cases

In the past, if an automaker did something wrong, they were usually prosecuted by the US government through something called the TREAD Act. Short for Transportation Recall Enhancement, Accountability and Documentation Act, it basically requires automakers to report recalls in other countries, along with any and all serious injuries or deaths, to the National Highway Traffic Safety Administration.
Failing to report or attempting to conceal anything when there's been a death or serious injury constitutes a criminal liability. The idea is that this setup puts the onus on manufacturers to keep NHTSA apprised of safety related issues before they become a problem in the US, thereby allowing the regulator to better protect consumers.
In theory, it sounds like a relatively airtight set of rules for dealing with misbehaving automakers. That didn't stop the US Department of Justice from ignoring TREAD in its prosecution of Toyota's handling of the unintended acceleration recall, though. The result of this new approach, which charged Toyota with wire fraud, was a $1.2 billion settlement. Now, the wire-fraud approach could be used for the expected case between the US government and General Motors, based on the statements of Attorney General Eric Holder, who specifically mentioned "similarly situated companies" when discussing Toyota.

The latest Deadly Rivals episode from Evo gets the Mazda MX-5 Miata and Toyota GT86 (our Scion FR-S) on track for a shakedown and a whole lot of drifting with Dan Prosser behind the wheel. The UK-spec coupes have slightly different power ratings than ours, but it's all close enough to be comparable. Their Miata has 158 horsepower (ours has 155), 148 pound-feet of torque, takes 7.3 seconds to run from naught to 60 62, and costs 22,695 pounds. The GT86, on the other hand, lists a 7.6-second dash to 60 62, and a base price of 25,000 pounds. The GT86 also weighs 400 pounds more than the Mazda. That's true in the States, too – curb weight for our MX-5 is 2,332 pounds, whereas the Scion FR-S comes in at 2,758 pounds. Both cars lauded for excellent shifting, but one of them has a better front end, a sweeter engine note, more controllable cornering behavior, and is faster by a tenth of a second around the test track. And Prosser doesn't mention it, but one has a lot more body roll. But it takes more than all that to make a winner, so check out the video above to see which is which. Toyota lowering Prius sticker prices in California

For the citizens of the state that has the biggest impact on Prius sales, it's understandable that Toyota might be offering its biggest perks there. With the next-generation version of the world's most popular hybrid not likely to see the light of day until the 2016 model year, the Japanese automaker is looking to spur sales as a stopgap measure. And that's especially true for the Prius C compact and the Prius Plug-in Hybrid. Toyota has bumped incentives for potential Southern California buyers of the Prius C to about $2,000 off the MSRP, which is up from $750 and about the same size of the perk given to prospective Prius Plug-in buyers, according to numbers from CarsDirect. For the standard Prius Liftback and the Prius V wagon, Toyota increased its discounts by about $500. The perks went into effect April 1 and will last until May 4. Toyota spokeswoman Amanda Rice confirmed to AutoblogGreen that the $2,000 incentive for the Prius C is specifically for the 2014 model year, and that the 2015 model year spurs a $750 incentive. She also confirmed that Toyota this month increased standard Prius lift back cash-back offer to $1,750 from $1,250, though amount offered can change by region. "While we will do what is necessary to remain competitive, Toyota's practice is to always lead with the product, not the deal," Rice wrote in an e-mail to AutoblogGreen. "The use of our incentives is tactical, reinforcing our value and focus on keeping our products competitive in the market." The Prius family was California's most popular passenger vehicle in 2012 and 2013, but sales since then have fallen off. Through the first quarter, US Prius sales were down 14 percent from a year earlier after falling 11 percent last year to about 207,000 units. A Toyota representative didn't immediately respond to a request for comment from AutoblogGreen on the increased incentives in the face of reduced sales. Related Videos:
