China fines Toyota $12.5 million over Lexus price-fixing

BEIJING — China's market regulator on Friday has fined Japanese carmaker Toyota Motor 87.6 million yuan ($12.5 million) for price-fixing on its premium Lexus cars in eastern Jiangsu province, according to a document on its website. The decision comes as China steps up regulation over auto sales in the world's biggest vehicle market, where more than 28 million cars were sold last year. The anti-monopoly bureau of State Administration for Market Regulation said that between 2015 and 2018, the Japanese carmaker set a minimum sales and resale price for its cars in coastal Jiangsu province, which deprived dealers of pricing autonomy and harmed customers' rights. Lexus also fixed sales strategies in the region over the period, including offering customers discounts while asking them to purchase accessories at fixed prices, a sales tactic usual among individual auto dealers in China but frowned upon for carmakers. A spokesman at Toyota, Lexus' parent firm, told Reuters the firm acknowledged the penalty and respects the decision. He did not comment further. China's auto sales are declining, but Lexus' sales keep growing. It sold 180,200 vehicles in the first 11 months this year, a 21% jump from a year earlier. In June, China's market regulator imposed an 162.8 million yuan fine on Ford Motor Co's joint venture with Changan Automobile Group for violating anti-monopoly law. Safety Agency Studying Toyota Acceleration Problem

A U.S. safety agency is looking into a consumer's petition alleging that older Toyota Corollas can accelerate unexpectedly at low speeds and cause crashes. The inquiry by the National Highway Traffic Safety Administration covers about 1.69 million of the Corolla compact cars from the 2006 to 2010 model years. The agency will decide whether to open a formal investigation into the problem. An unidentified consumer said in a letter to the agency that he experienced multiple low-speed surges in a 2010 Corolla, and the brakes failed to stop the car in time to prevent a crash. The consumer said the problem caused one collision with a parked vehicle on June 8. "In addition to evidence from our crash incident, we are providing evidence that many other Corolla owners are experiencing similarly unsafe scenarios that are leading to crashes," said a portion of the consumer's letter posted Monday on NHTSA's website. The consumer provided 163 reports from other drivers who experienced a surge at low speed or no speed. But NHTSA said it eliminated duplicates, those outside the scope of the 2006-2010 model years and those from foreign countries to get 141. No injuries were reported. The agency said it would evaluate all of the complaints from the consumer in order to decide whether to grant or deny the petition and open a formal investigation. The consumer filed the petition on Sept. 11, according to the documents. Messages were left Monday morning seeking comment from Toyota. In 2009 and 2010, Toyota issued a series of recalls totaling more than 10 million vehicles for various problems including faulty brakes, sticky gas pedals and ill-fitting floor mats. Toyota is under pressure to announce recalls quickly after a U.S. government investigation found it hid information about past defects. Last month, the company agreed to pay $1.2 billion to settle that investigation. It also paid fines totaling $66 million to the U.S. government for delays in reporting unintended acceleration problems. Toyota profits up 23% on high US sales, despite mounting legal costs

Toyota earned $9.3 billion in net income in the financial year that ends next month. The number beats earlier forecasts and marks a five-year high for the automaker, with both operating income and revenue up by 9.5 percent and 2.5 percent, respectively. Toyota saw quarterly profit enjoy a year-on-year jump of 23.4 percent, with the manufacturer earning more than $1 billion between October and December 2012. The good news comes in spite of the fact that the Japanese automaker actually endured an operating loss in North America, due in part to legal fees.
Toyota is set to pay more than $1 billion to owners who claim their vehicles decreased in value as a result of the company's recent spate of recalls. Even so, all three of the automaker's brands enjoyed a 13.5 percent sales increase in the US in the last quarter, beating the industry average. Toyota faltered in Europe, however, where it earned $99 million in operating profit last year, compared to $111 million in 2011.
