Legal approach in $1.2 billion Toyota settlement could impact handling of GM recall cases

In the past, if an automaker did something wrong, they were usually prosecuted by the US government through something called the TREAD Act. Short for Transportation Recall Enhancement, Accountability and Documentation Act, it basically requires automakers to report recalls in other countries, along with any and all serious injuries or deaths, to the National Highway Traffic Safety Administration.
Failing to report or attempting to conceal anything when there's been a death or serious injury constitutes a criminal liability. The idea is that this setup puts the onus on manufacturers to keep NHTSA apprised of safety related issues before they become a problem in the US, thereby allowing the regulator to better protect consumers.
In theory, it sounds like a relatively airtight set of rules for dealing with misbehaving automakers. That didn't stop the US Department of Justice from ignoring TREAD in its prosecution of Toyota's handling of the unintended acceleration recall, though. The result of this new approach, which charged Toyota with wire fraud, was a $1.2 billion settlement. Now, the wire-fraud approach could be used for the expected case between the US government and General Motors, based on the statements of Attorney General Eric Holder, who specifically mentioned "similarly situated companies" when discussing Toyota.

Tesla, Toyota and General Motors addressed the House Subcommittee on Information Technology about the security and benefits of "The Internet of Cars." Tesla put forth four suggested security principles for the security of connected cars. Those include standard cryptography ("signing") used by automakers, measures to prohibit direct connection over the internet, isolation of a car's networked systems from its mechanical systems and standard encrypted communications protocols. Tesla VP of Business Development Diarmuid O'Connell also urged against "overly restrictive regulation." O'Connell says, "Regulation at a time of rapid innovation runs the risk of limiting the realization of the full extent of safety advances." The partners will add 500 fast-charging sites to the eVgo network in 25 cities by the end of 2015. The "Fast Combo" chargers will be available to use for free for BMW i3 customers for 24 months. The free charging only applies to new buyers, though, leaving behind some 15,000 current i3 owners. The automaker's in-house transport company, Toyota Transport, will operate the truck out of Long Beach, California. The truck, which Toyota says emits 85 percent less particulate matter and 10 percent less CO2, will drive about 7,000 to 8,000 miles per month. "We started exploring the CNG option more than three years ago, and it has been worth the wait," say Toyota Transport Compliance Senior Analyst Kirk Welch. "Natural gas is the cleanest burning fossil fuel and will help Toyota advance our environmental efforts to reduce fleet emissions." Read more in the press release below. With the Chevrolet Colorado and GMC Canyon set to arrive in dealers in the near future, it's high time Toyota got to work on a replacement for the Tacoma, a vehicle whose present generation debuted in the middle of the Bush Administration. Now, we have images of that new pickup undergoing testing.
Our spy photographers picked up this heavily modified mule undergoing tow tests in the desert. It rides on a modified version of the current Taco's frame, as evidenced by shots of its undercarriage, although our spies cite the lack of riveted sections as indications that the current truck's footprint should remain unchanged.
Aside from underbody changes, this particular Tacoma featured a six-speed manual transmission, which we're expecting to be joined by a six-speed automatic. The current four- and five-speed autos found on the current truck will almost certainly be killed off. Marching to the grave with those slushboxes will be the two-door Regular Cab body style. Our spies are expecting Toyota to focus its efforts on the larger, more accessible Double Cab.
