Toyota sudden acceleration class action may cover 22 million owners

A total of 22.6 million current and former Toyota owners have been sent notices that they may be eligible to receive compensation from the automaker for damages related to the unintended acceleration fiasco that has dominated headlines in 2009 and 2010. The total payout may be as high as $1.63 billion, according to The Detroit News.
Steve Berman, a lawyer for the owners, calls the potential deal "a landmark, if not a record, settlement in automobile defects class action litigation in the United States." Still, there's some debate about whether or not Toyota's proposed settlement is fair, as it includes $30 million for safety research and driver education programs - in other words, Toyota seems to be suggesting that drivers need more education on how to drive their correctly working and fully functional vehicles. For those keeping track, Toyota would also be paying lawyer fees of $200 million.
A US District Judge in California is scheduled to hold a so-called "fairness hearing" on June 14 that could decide the fate of this particular settlement. Further courtroom wrangling will be required to hash out any wrongful death suits levied against Toyota stemming from unintended acceleration claims, as those are not part of this class-action suit.

Data from Insurify shows which models have the most accident-prone drivers behind the wheel. It also shows the proportion of the drivers of said vehicles with an at-fault accident on record in the past seven years, based on Insurify’s analysis of over 4 million car insurance applications. Now, it would be easy to infer that these cars are dangerous, but such is not necessarily the case. Remember, drivers cause accidents, not cars. Lexus CT Another hybrid, this Prius-powered Lexus beats the national average at 14.57%. 8. Toyota Prius V Yet another hybrid, the larger but discontinued member of the Prius family sees 14.72% of its drivers with recent accidents. 7. Mazda CX-3 The Mazda CX-3, which is discontinued for the 2022 model year, sees the accident-prone making up 14.9% of its drivers. 6. Infiniti Q60 The second and final luxury car on this list has more accident-prone drivers than average, at 14.93%. 5. Subaru Impreza The first of two Subarus on this list has 15.1% of drivers with recent accidents on record. 4. Hyundai Genesis Coupe The Genesis Coupe was only on the market for a brief span before it was discontinued and Genesis spun off into its own luxury brand. That said, it too beats the national average for accidents, at 15.29%. 3. Subaru WRX Despite its standard all-wheel drive, the boy-racer WRX has 15.44% of drivers with a prior accident in the last seven years. 2. Toyota takes aim at Musk's criticism of hydrogen 'fool cells'

Tesla's Elon Musk has called hydrogen fuel cell cars "a load of rubbish" and "fool cells," and he's nowhere near alone in his disdain for the technology. Toyota has been fighting back waves of condescension for years now, and did so again when Senior VP Bob Carter took the stage at the recent J.D. Power Automotive Summit this month. His target was comments that Musk made at the Automotive News World Congress at the Detroit Auto Show, when Musk said an FCEV was an "extremely silly way" to store energy, that "the best-case hydrogen fuel cell doesn't win against the current-case battery" and that hydrogen's failings will become obvious in the next few years. Carter's response was that the fuel cell initiative isn't about the next few years. "This is not a 24-to-36-month play, but when you start looking into the 2020s," then you can see the necessity of hydrogen fuel cells, which Toyota considers an extension of EV technology, he said. The Toyota Mirai will begin its defense of the FCEV industry in the US later this year. The Hyundai Tucson Fuel Cell is already available in California and Honda's hydrogen car will arrive in 2016. Until then, we can let some more of Carter's words ring in our ears: "If I was in a position where I had all my eggs in one basket," he said of Musk's BEV-only focus, "I would perhaps be making those same comments."
