Legal approach in $1.2 billion Toyota settlement could impact handling of GM recall cases

In the past, if an automaker did something wrong, they were usually prosecuted by the US government through something called the TREAD Act. Short for Transportation Recall Enhancement, Accountability and Documentation Act, it basically requires automakers to report recalls in other countries, along with any and all serious injuries or deaths, to the National Highway Traffic Safety Administration.
Failing to report or attempting to conceal anything when there's been a death or serious injury constitutes a criminal liability. The idea is that this setup puts the onus on manufacturers to keep NHTSA apprised of safety related issues before they become a problem in the US, thereby allowing the regulator to better protect consumers.
In theory, it sounds like a relatively airtight set of rules for dealing with misbehaving automakers. That didn't stop the US Department of Justice from ignoring TREAD in its prosecution of Toyota's handling of the unintended acceleration recall, though. The result of this new approach, which charged Toyota with wire fraud, was a $1.2 billion settlement. Now, the wire-fraud approach could be used for the expected case between the US government and General Motors, based on the statements of Attorney General Eric Holder, who specifically mentioned "similarly situated companies" when discussing Toyota.

Toyota kicked off production of the Mirai hydrogen fuel cell sedan at its Motomachi factory campus in December, and at the time the company had orders for 200 of them. In just the few months since then, demand has already jumped to requests for at least 1,500 of the potentially revolutionary vehicles. For the first time, the Japanese brand is taking viewers into the innovative model's production process and showing the sedate pace of putting them together. The line used for the Mirai was formerly home to Lexus LFA production. Like that low-volume, cutting-edge supercar, Toyota is prioritizing quality and precision for its fuel cell vehicle. At the moment, it's building just three of the sedans per day with a tight, dedicated team. According to Automotive News, there are just 13 people assembling the cars right now, and at most they could only complete 10 per day. The production process for the Mirai is more akin to a boutique sportscar than the high-volume efficiency Toyota usually shows. There's no belt moving them along, and instead each one is pushed between areas. With so much riding on these models, this approach is meant to guarantee an attention to quality. "These facilities are not so advanced. Rather, we rely on the work of our skilled employees. This is similar to how things were when Toyota was just starting out," said Toyota President Akio Toyoda during a ceremony at the plant, according to Automotive News. Toyota has released a gallery of images and five videos showing the major steps in the Mirai's production process, including the complicated installation of the fuel cell stack. Ryan Tuerck's Ferrari-powered Gumout GT4586 debuts at SEMA

Las Vegas is famous for its shotgun marriages, but the only Sin City nuptials we're interested in is the one officiated by Ryan Tuerck between a Toyota GT86 and the V8 engine from a Ferrari 458 Italia. The insane Gumout GT4586, as it's called, is probably one of the most well-known of the 2016 SEMA Show's stars, after video popped up showing the rear-drive Frankenstein firing up and spitting flames through its weird, front-mounted exhausts. The day after we published that video, which showed the GT86 in mostly bare frame, Gumout and Tuerck posted a second clip showing the Japanese-Italian coupe literally running rings around a 458 while wearing its sheetmetal and yellow-tinted headlights. The car's look in that second video carried over to the Las Vegas Convention Center floor, where the GT4586 showed up sans hood, ludicrously wide tires, and a huge wing and rear diffuser.
