Volkswagen forced to sell stake in Suzuki

The six-year-long failed marriage between Volkswagen and Suzuki has finally come to an end. Almost. An arbitration panel in London issued its final verdict which, according to a VW press release, cleared Suzuki in terminating the agreement, so VW now needs to get rid of its 19.9-percent share. However, the tribunal's decision said VW performed all of its obligations and Suzuki didn't – the Japanese carmaker should have given VW last-call rights for a delivery of diesel engines, but failed to. The breach opens Suzuki up to damage claim, but so far VW only says it reserves the right to sue. Now that Suzuki has an outside investor to provide funds it meant to get from VW, perhaps both can get back to their reasons for being. The press release is below. As a result, cooperation between the two parties is deemed terminated. The arbitrators confirmed that Volkswagen met its contractual obligations under the cooperation agreement and found that Suzuki has terminated the agreement upon reasonable notice. Volkswagen will therefore now dispose of its 19.9 percent stake in Suzuki and expects a positive effect on the Company's earnings and liquidity from the transaction. The arbitral tribunal also confirmed that Suzuki breached its contractual obligations to Volkswagen under the agreement and that Volkswagen has the right to claim damages. "We welcome the clarity created by this ruling. The tribunal rejected Suzuki's claims of breach and found that Volkswagen met its contractual obligations under the cooperation agreement. Nevertheless, the arbitrators found that termination of the cooperation agreement by Suzuki on reasonable notice was valid, and that Volkswagen must dispose of the shares purchased.

NASA is building an all-electric test aircraft called the X-57. The lightweight plane's design balances speed with efficiency. The European model has a lithium-ion battery pack under the front passenger seat that stores energy from a regenerative braking system to supplement power from the 1.2-liter engine during acceleration. The Borgward BX7 plug-in hybrid SUV has won several Plus X Awards. The revived German automaker's PHEV received awards in the categories of Design, High Quality, Ergonomics, and Functionality. Any Plus X Award winner must display added value, which the panel of judges call the "Plus X Factor." General Motors and the US Navy are teaming up to power underwater drones with hydrogen fuel cells. The Navy's goal is to provide its large displacement unmanned undersea vehicles (UUVs) with 60 days of operation between refueling. "Our in-water experiments with an integrated prototype show that fuel cells can be game changers for autonomous underwater systems," says Frank Herr, head of Ocean Battlespace Sensing at the Office of Naval Research. "Reliability, high energy, and cost effectiveness – all brought to us via GM's partnering – are particularly important as Navy looks to use UUVs as force multipliers." GM says that just as on-road experience gained through its Project Driveway fuel cell test fleet is valuable, automotive customers stand to benefit from lessons learned from this naval project. 205k Suzuki models being investigated for airbag sensor issue

The Detroit News is reporting that the National Highway Traffic Safety Administration has opened an investigation on the 2006-11 Suzuki Grand Vitara and 2007-11 Suzuki SX4 due to issues with the airbag and seatbelt for the front passenger seat. So far, NHTSA has received 128 complaints on these vehicles for airbag warning lights, airbag off lights and seatbelt lights, on a vehicle set that totals around 205,000 units, but there is no indication as to how many, if any, injuries have reported.
Via technical service bulletins, Suzuki has already acknowledged two airbag-related issues with front passenger seats on both vehicles, including a programming error for the passenger seat load indicator on 2009 models and an open-circuit problem for the sensor mat that determines if an adult or child is sitting in the front seat. Since this latter issue would not shut off or lessen the impact of the passenger airbag, Suzuki has already extended the warranty for the seat cushion bottom to 10 years or 120,000 miles. After ceasing new-car sales in the US and Canada, potential recall repairs (which still may or may not happen) would be handled by remaining dealers as laid out in the recent court-approved bankruptcy plan.
