Warning - Engine part missing after garage repair

Berry`s Garage lost the top engine cover during repair and will not replace it or compensate me for its loss. I had a timing belt and water pump replaced at Berry`s garage. When I next checked the oil after I had picked the car up, I noticed that the top engine cover, a part measuring over one-foot square that sits on top of the engine, was missing. I notified the garage that it was missing. They looked in th... view moree shop for it and did not find it. They said that they would to to locate a replacement for me. Two weeks later after hearing nothing from the garage, I stopped back in. This time they said that either it had fallen off (not likely bcause it`s bolted on with four bolts), or that it wasn`t there when the car was towed in to the garage. I know it was in place when it was towed because I had unhooked a trickle charger to the battery just before it was towed to Berry`s Garage.
