GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Porsche Boxster Spyder to get GT3's 4.0-liter flat six?

It's been a merry-go-round the past few months, the rumormill focused on what will power the next Porsche Boxster Spyder. First came hearsay of a flat-six going into the special edition of a model line known for its turbocharged four-cylinder engines. Then came tattling that the flat-six in question was the naturally aspirated, 4.0-liter from the 911 GT3. A couple of weeks ago we wrote " we'd be surprised if Porsche packed anything other than a turbocharged flat-four under the skin." But Autocar has a new report that, indeed, a downtuned version of the 500-horsepower 4.0-liter from the GT3's rump will move to the Boxster Spyder's midsection. The Autocar piece follows a Wheels magazine article from last November, and the prediction isn't outrageous. When Car and Driver reviewed the last Boxster Spyder, it wrote, "the hand-me-down six comes from the older 911 Carrera S, not to be confused with the new turbocharged 3.0-liter flat-six that powers the refreshed 911." If we can believe a recent report from Automobile about the 992-series 911 due later this year, the same thing is happening: The 991.2-series GT3 bequeaths its powerplant to the smaller sibling, and the 992-series GT3 moves to a 3.8-liter, twin-turbo flat-six with around 550 hp. Autocar quotes Andreas Preuninger, the Porsche engineer leading the development of all of these wunderkinds, saying of the Boxster earlier this year, "Natural aspiration is one of our main USPs. ... [We] think we can achieve throttle response and immediacy a little bit better with an atmospheric high-revving engine than any kind of turbo." We'll guess that means, by inference, that the GT3 is about to age out of naturally-aspirated university. The limited-edition Boxster Spyder might carry the torch with the 4.0-liter, with output somewhere around 430 hp. The Cayman GT4 could do the same. Or, who knows, an evolution of the 375-hp, 3.8-liter flat-six in the previous Boxster Spyder might burble out of left field. We expect to see the Boxster Spyder late this year. Until then, we'll wait to see what the merry-go-round says next time the Zuffenhausen horse comes around. Another Burt Reynolds Trans Am is up for auction

Fans of Smokey and the Bandit, your car has arrived. This Saturday, January 21, Barrett-Jackson will auction a 1977 Pontiac Trans Am clone that, while not originally in the movie, was owned and signed by the Bandit himself, Burt Reynolds. Not only that, but it packs many modifications that should make this Pontiac drive the way we all imagined it did. This is a Trans Am clone, not an original. The car was built by Nebraska company Restore A Muscle Car, and started life as a lowly Firebird Formula. However, the company brought it up to Trans Am grade and beyond. Under the hood is a fuel-injected 8.2-liter V8 from Butler Performance that Restore A Muscle Car says produces 600 horsepower. Coupled to the big V8 is a Tremec five-speed manual transmission. There's even Hurst line-lock on-board, so this Trans Am should be perfect for on-demand burnouts. The car also comes with QA1 coil-over suspension, so it should corner better than the original, too. The outside looks roughly like a stock Trans Am, but it now has 18-inch wheels styled after those from the movie car, and the shaker scoop says "8.2" on each side. View 5 Photos In 2014, a 1977 Trans Am owned by Reynolds sold for a whopping $450,000. That car wasn't an actual movie car either, and lacked the modifications of this one. However, it was used as a promotional car and was given to Reynolds, so it did have some history with the film. This upgraded car is listed in the Barrett-Jackson catalog as "no reserve," so it's going home with a new owner on Saturday, regardless of price. Related Video:
