GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Junkyard Gem: 2010 Pontiac G6

What makes a discarded car a gem? Sometimes it's a car we all agree is very cool, and other times it's a car that tells us something about automotive history. Today's Junkyard Gem is the latter type: one of the very last Pontiacs sold, before The General shut out the lights forever on the storied marque after 84 years. The G6 was Pontiac's Epsilon-platform-based car, sibling to the Chevy Malibu, Saturn Aura, and Saab 9-3 (plus a bunch of Europe-only machinery). The very last Pontiac ever built was a white 2010 G6 sedan like this one (all '10 G6s were sedans, the coupe and convertible having been nixed in 2009), though that car was built in January of 2010 and this one came off the line in July of 2009. They build Bolts at the Orion Assembly plant these days. The higher-zoot G6s came with V6s or even V8s, but this car has "fleet machine" written all over it and has the base 2.4-liter Ecotec four-banger making 164 horsepower. Pontiac shoppers in the United States could buy the Vibe as a 2010 model as well, while Mexican Pontiac dealerships also sold new G2s (known as the Spark here) that year. The G6 was The Final Pontiac, though, bookending a run that began with the 1926 Pontiac Six. This one will go to its grave with the original owner's manual still inside. Junkyard Gem: 2000 Pontiac Sunfire coupe

In a few months, we'll reach the tenth anniversary of GM's axing of the venerable Pontiac brand. G6s, Vibes, and Matizes continued to be built until 2010, but I'm noticing a marked decrease in discarded Pontiacs lately, as I perform my junkyardy rituals. Here's a 2000 Pontiac Sunfire, photographed in a Colorado wrecking yard. The Sunfire was the near-identical sibling to the Chevrolet Cavalier, based on the long-running (1982-2005) J-Body platform. It was cheap and simple, looked pretty sporty (at least in coupe form), and every parts store in North America carried just about everything you'd need to keep one running. This coupe had to compete for sales not only with a vast and menacing array of imports but with GM's own Saturn SC2 (not to mention the Cavalier itself). Meanwhile, the J platform was showing its age more with each passing year. This car sports what must have been the complete line of Fatal Clothing bomber-nose-art/skate-punk/gang-tag-influenced decals, circa 2010. I actually photographed this car back in 2011, then misplaced the image files until last week. The stickers are very California-centric for a Colorado car, but then plenty of Californians — including me— move here. When you know you're a car's final owner, it's a lot easier to whip out the paint pens and redecorate the interior. Power came from the engine GM developed for the very first J-Bodies: the 2.2-liter 122 pushrod four-cylinder. 2002 was the last model year for 122-powered Sunfires and Cavaliers; the most affordable S-10/Sonoma/Hombre trucks got this engine through 2003.
