GM isn't liable for punitive damages in ignition switch cases
Wed, Nov 20 2019NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Celebrate the summer solstice by building the Pontiac Solstice shooting brake GM never did
Fri, Jun 21 2019Happy summer solstice, everyone! To celebrate, we have a particularly unusual eBay find connected to the Pontiac Solstice sports car. A seller has leftover inventory of fiberglass hardtops designed to turn the Pontiac Solstice roadster into a shooting brake. The seller says they came from a since-closed Indiana company, and they're clearly inspired by another aftermarket part and even a GM concept that never saw the light of day. We'll start from the beginning: the stillborn Chevy Nomad concept. It was a concept that came out about the same time as the original Solstice concept, and it was clearly based on the same platform, featuring a small two-door body and a long nose. It also had unashamedly retro Nomad wagon design cues and cues from the original Corvette. The car never saw production, but clearly people were interested in having a wagon-like sports car. That brings us to the next bit of history with an aftermarket hardtop developed by German company EDAG. We saw a prototype in person, and the overall shape seemed to fit the car — and the wraparound window design certainly seemed Nomadic. Besides the unique look, the hardtop and its functional hatch made the Solstice roadster's miniscule cargo space far more usable. It doesn't appear many of the tops were sold, though. These tops on eBay look very similar to the EDAG tops, though it's not clear if they're a direct replica or something similar. Being that the parts are leftover inventory, the seller notes that some of the tops may be missing pieces for installation, so only those who are handy with bodywork and fasteners, or who are able to lean on someone who is, need apply. Even with some extra work, if you really want a Solstice shooting brake, this is likely easier and cheaper than commissioning a shop to custom-build a roof for your. Rent the 1967 Pontiac GTO from the XxX films now on Turo
Tue, Jan 10 2017The process of renting a car usually ranges from mildly annoying to "I'm calling corporate to get you fired." Plainly, it sucks, but sometimes you're left with no alternative. Turo, a peer-to-peer carsharing network, has created what's essentially the AirBnB for cars. Like AirBnB, the quality and variety of the rides varies based on location. If you're in Tucson, Ariz., in the next week, go check out this 1967 Pontiac GTO convertible before the release of XxX: The Return of Xander Cage. Promotions and marketing aside, this is still the opportunity to drive one of the original muscle cars. It's not clear if this is an original GTO or a Pontiac Tempest that was converted, but does it really matter? Old cars never drive as well as you hope, so, as long as it looks and sounds awesome, who cares? The owner listed on Turo is Xander C., Vin Diesel's character from the XxX franchise. This is the car that was used in the original 2002 film, and from the photos it appears to be in better shape than many other movie cars. The exterior is mostly stock, with some slight modifications to the lighting, wheels, exhaust, and trim, with the addition of a funky looking hood scoop that the listing claims shoots flames. It's not clear if it functions as an actual intake because there aren't any notes about what rests under the hood. The listing does ask for premium fuel, so more than likely it's some variation of a high-compression V8. Inside, the dashboard looks like someone raided the AutoZone accessory aisle. There are gauges, dials, toggle switches, and readouts galore. The listing also claims the Goat is packing a rocket launcher and a weapons stash under the seat. $999 per day isn't cheap, but it's less than you'd pay for a day with one of the rent-an-exotic shops you see in Los Angeles or New York. If you're not in Tucson or the price is a little too steep, Turo has what it's dubbed the Adrenaline Collection. The name may be hyperbole, but the lineup of cars is actually really solid. A quick glance reveals a 2015 Lamborghini Huracan, 2001 Ferrari 360 Spider, and a 1969 Jaguar E-Type. The car list keeps expanding, so if this proves popular, look for more cool stuff in the future.
