GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. 2013 Hurst Edition Trans Am

No, you didn't read our title wrong. This is a 2013 model year Trans Am, and yes, that is a Pontiac logo affixed to the front of the car. But don't bother dialing up your local General Motors dealership just yet. This is the new Hurst Edition Trans Am created by the Trans Am Depot located in Tallahassee, FL. Having spent a number of years restoring early Trans Am models, the crew at Trans Am Depot finally did what many Pontiac enthusiasts wish GM would have done - create a modern Trans Am using the fifth-generation Chevrolet Camaro.
As the former owner of a 1977 model, I've been wanting to check out Trans Am Depot ever since I first saw the company have American Choppers build a trio of motorcycles inspired by its Pontiac remakes. So I jumped at the chance to head to Florida's capital city to visit the shop and drive its latest creation, the new Hurst Edition Trans Am. As a collaboration with Hurst, this car made its debut at the 2012 SEMA Show and then popped up again on our radar with a cheesy yet perfectly fitting video back in March.

Online Find: 1970 Pontiac Firebird Concept, cousin of the Weinermobile

So there's this for sale over at Hemmings: the 1970 Pontiac Firebird One concept designed by Harry Bentley Bradley and built by Dave Crook. For sale at the time of writing in Bellevue, Washington for $94,950, most of the seller's description appears to be pulled from a 2001 Barrett-Jackson listing, when the car was sold at auction for $61,600. Before we get to the car, it helps to know the man behind it: Bradley was a designer at General Motors from 1962 to 1966 who, against company policy, continued to submit designs to Hot Rod magazine under an assumed name. Mattel poached him in 1966 to design its brand new toy line called Hot Wheels, and Bradley designed all of them except one. He only stayed at Mattel for a year because he didn't think Hot Wheels would be successful, then left to start his own design company. Among other works, he penned the most recent example of the Oscar Mayer Wienermobile. Now can you see the Firebird One's design language? Since it apparently has a letter of documentation from GM design staff, we'll assume that GM asked the then-freelancing Bradley to work some magic on its muscle car, this being the totally Hot-Wheels influenced result. There are 17,456 miles on its 255-horsepower, 350 cubic-inch V8. The interior has tan leather, custom bucket seats, a wood grain dash, and one of the most awkward spare tire placements ever. The seller assures all prospective buyers that it is, like the Death Star, "fully operational."
