Nissan files civil suit against Ghosn, seeking $91 million in damages

TOKYO — Nissan filed a civil suit Wednesday seeking 10 billion yen ($91 million) in damages from the Japanese automaker's former Chairman Carlos Ghosn. Nissan filed the case in Yokohama District Court to recoup some of the monetary damages suffered, it said, “as a result of years of misconduct and fraudulent activity" by Ghosn. The claim was calculated by adding the costs from what Nissan called Ghosn's “corrupt practices,” such as rent for overseas property, use of corporate jets and payments to Ghosn's sister, as well as costs for the internal investigation into Ghosn's alleged wrongdoings. Representatives of Ghosn said in a statement they couldn't comment as they had yet to see the legal documents. “Nissan's maneuvers continue,” they said, while noting Nissan had claimed larger damages before. Ghosn, who led Nissan for two decades and saved it from near-bankruptcy, was arrested in Japan in November 2018, and charged with underreporting his future compensation and breach of trust in diverting Nissan money for personal gain. He was awaiting trial but skipped bail and showed up in Lebanon late last year. Japan has no extradition treaty with Lebanon, and he's unlikely to be arrested. A date had not been set for his trial, and Ghosn has said he was worried his ordeal would never end and he would not get a fair hearing. The bail conditions also barred him from seeing his wife. He has repeatedly lashed out at Japan's judicial system, where the conviction rate is higher than 99%. Japanese authorities recently issued an arrest warrant for Ghosn and three Americans, accused of helping his escape. Separately, they issued an arrest warrant for Ghosn's wife on suspicion of perjury. Ghosn has repeatedly said he is innocent, saying that the promised compensation had never been decided, and all the payments were for legitimate services. Wednesday's lawsuit by Nissan comes on top of the civil case Nissan filed against Ghosn in the British Virgin Islands in August last year. It alleged unauthorized payments, sought to regain a luxury yacht and pursued other damages, according to Nissan. Yokohama-based Nissan, which makes the Z sportscar, Leaf electric car and Infiniti luxury models, is also facing trial in Japan as a company in relation to Ghosn's scandal. It has indicated it will agree to any penalties. Nissan's reputation has been sorely tarnished over the Ghosn fiasco, and its sales have dropped. Nissan reports financial results Thursday.

Nissan already planning for EV sales once incentives run out

The way Nissan looks at it, no good deed goes unpunished. The Japanese automaker will likely be the first to see federal incentives for its electric vehicles disappear. And the company may already be trying to work out some wiggle room with the powers that be. The issue is that the Nissan Leaf is the most popular electric-vehicle in the US, moving more than 77,000 vehicles since the model's late-2010 debut. Sales have likely been helped by the $7,500 federal tax credit for EVs (along with additional state incentives), but that perk starts to disappear for Nissan once the automaker has sold a cumulative 200,000 EVs. Even though that's likely a few years off, Nissan North America executive Pierre Loing told Wards Auto that the company is talking with the feds to see if there is "room for negotiations." In the meantime, Nissan is trying to further cut battery-production costs in order to both reduce the price on the Leaf and lengthen its single-charge range. Nissan notably shaved $6,400 off of the Leaf's sticker price in early 2013, and that seems to have worked wonders. Leaf sales more than doubled that year to 22,610 units and jumped another 34 percent last year to 30,200 units. Recharge Wrap-up: Reverse graffiti powered by Nissan Leaf; BMW introduces Wallbox Pro

BMW has a new, faster version of the Wallbox home EV charger. The Wallbox Pro offers 7.4 kilowatts, and can charge the BMW i3 to 80 percent in under three hours. It features a seven-inch touchscreen and proximity sensor, plus an 11.5-foot cord. The Wallbox Pro can also be used with smart home systems such as lighting and heating. The Wallbox Pro is available in Europe, and will come to the US later in the year. Read more at Hybrid Cars. Nissan is using the Leaf to power the creation of "reverse graffiti" in London. The company has commissioned artist Moose to selectively wash dirt off of a wall outside of a subway station, leaving behind a mural of London landmarks. Moose used a jet washer powered by the Leaf's battery to create the piece. The goal is to highlight the amount of pollution in London and other large cities, which is not a new idea. "It is a reminder that electric vehicles don't have an exhaust to emit the kind of air pollution which has stained the wall Moose has created his piece on," says Nissan's Jean-Pierre Diernaz. The car was printed with 212 layers of carbon-reinforced ABS thermoplastic. After printing, the team then spent two days finishing the car to make it run. It is powered by the drivetrain from a Renault Twizy, and is capable of 40 miles per hour.
