What to expect from the Japanese trial of Nissan and Greg Kelly

TOKYO — The criminal trial against Japanese automaker Nissan and its former executive Greg Kelly will open in Tokyo District Court on Tuesday. ItÂ’s the latest chapter in the unfolding scandal of Carlos Ghosn, a superstar at Nissan until he and Kelly were arrested in late 2018. Five questions and answers about the trial: Q: WHAT ARE THE ALLEGATIONS? A: The charges center around KellyÂ’s role in alleged under-reporting of GhosnÂ’s future compensation by about 9 billion yen ($85 million), a violation of financial laws. Kelly says he is innocent. Nissan, which is also similarly charged, has already acknowledged guilt, made corrections to the compensation documents submitted to the authorities, and has started paying a 2.4 billion yen ($22.6 million) fine. Q: WHAT HAPPENS TO GHOSN? A: Probably nothing. He skipped bail late last year and is now in Lebanon, which has no extradition treaty with Japan. Two Americans, Michael Taylor and his son Peter Taylor are being held in Massachusetts without bail, suspected of having helped Ghosn escape by hiding in a box on a private jet. A U.S. judge recently approved their extradition to Japan. The case is now before the U.S. State Department. Q: HOW DO CRIMINAL TRIALS PROCEED IN JAPAN? A: The trial, before a panel of three judges, is expected to take about a year. There is no jury. Juries are selected only for extremely serious cases in Japan, such as murder. In principle, there are no plea bargains although backroom deals are made all the time. Closed pre-trial sessions are held ahead of the trialÂ’s opening, often for months before the real trial begins. Japan's legal system has come under fire from both within and outside the country as “hostage justice” because suspects often are held for months and interrogated without a lawyer present, often leading to false confessions, according to critics. Q: WHAT ARE KELLYÂ’S CHANCES? A: More than 99% of criminal trials in Japan result in a conviction. Japanese Justice Minister Masako Mori, in an online presentation in English hosted by the Japanese Embassy in the U.S., argued the conviction rate is so high because Japan prosecutes only about a third of the cases that come up, choosing only those that “result in guilty verdicts.” She insisted there is a “presumption of innocence.” She declined comment on KellyÂ’s case.

Nissan recalls Rogue, Pathfinder, Infiniti QX60 for seat issue

Nissan and Infiniti are recalling their 2023 Rogue, Pathfinder and QX60 SUVs and CUVs to address a potential defect in their seat frame welds that can allow the frames to fail in the event of a collision. The number of vehicles that potentially shipped with weak welds is rather small — just over 12,000 — but the issue could nonetheless lead to injury if a failure occurs during a collision.  "The driverÂ’s powered seat may not be fully secured to the seat frame on certain Nissan Rogue, Pathfinder, and INFINTI QX60 vehicles," Nissan's report to NHTSA said. "As a result of this issue, the seat frame welds may detach from the rear inboard seat bracket. If this condition occurs, it may increase the risk of injury to the occupant in the event of a crash. In addition, the seat frame assembly may not meet certain FMVSS 207 and FMVSS 210 requirements because of this condition," Nissan said.  Nissan says there's no easy way for customers to detect the issue ahead of time, and that its seats need to be inspected by a service tech to see whether it is properly secured. Dealers will be instructed to check the driverÂ’s seat rail clearance to the inboard seat bracket, and if necessary, the dealer will remove and replace the affected driverÂ’s seat cushion frame, NIssan said. This Leaf glows in the dark

Pessimists may say that it's weird to have an all-electric vehicle look like it's radioactive. But when it comes to an effort by Nissan Europe to publicize the idea of using solar energy to power one's house or car, that'd be missing the point. Either way, the car looks pretty cool. Nissan is looking to get more people to go solar across the pond, and has given an all-electric Leaf a special glow coating to get the point across. Nissan worked with inventor Hamish Scott to create a special coating that allows the Leaf's paint job to absorb enough sunlight to give off a glow for as long as 10 hours of darkness. Go up to the Nordic countries, and that's still not long enough to get through a winter's night, but for most of the Continent, that'd certainly be sufficient. Better yet, the coating, which catches ultraviolet energy, is fully organic, though it'd take some smart science people to figure out how that's the case. But the coating is said to last a quarter century, which is a little longer than Leaf batteries are expected to last. The manufacturer worked with inventor, Hamish Scott, creator of STARPATH, which is a spray-applied coating that absorbs UV energy during the day so that it glows for between eight and 10 hours when the sun goes down. While glowing car paint is already available, as are glow-in-the-dark car wraps, the bespoke, ultraviolet-energized paint created especially for Nissan is unique thanks to its secret formula made up of entirely organic materials. It contains a very rare natural earth product called Strontium Aluminate, which is solid, odorless and chemically and biologically inert.
