Japan prosecutors seek 2 years in prison for ex-Nissan exec Greg Kelly

TOKYO — Japanese prosecutors demanded two years in prison for former Nissan executive Greg Kelly and accused him of joining a “conspiracy” to pay his former boss Carlos Ghosn illicitly in closing arguments Wednesday in a yearlong trial. “That unpaid compensation existed is clear,” prosecutor Yukio Kawasaki told the Tokyo District Court, reading briskly from a thick document. Kelly, a 30-year veteran at the Japanese automaker, was living in the U.S. when he was arrested in November 2018 upon returning to Japan to attend a meeting. The first American to be appointed to NissanÂ’s board, Kelly says he is innocent. He sat calmly in the courtroom, wearing his usual red tie and dark suit, alongside defense lawyers. Everyone in the courthouse was wearing a mask because of the pandemic. Kelly told The Associated Press in an interview last month he did not know all the details of GhosnÂ’s pay. He was determined to retain Ghosn, Nissan's former chairman, because of his extraordinary management skills and wanted to pay him in a legal way, he said. Ghosn was arrested at the same time as Kelly and also maintains he is innocent. He skipped bail in late 2019 and fled to Lebanon, the country of his ancestry. It has no extradition treaty with Japan. The charges center around a pay cut of about 1 billion yen ($10 million) a year that Ghosn voluntarily started taking from 2010, halving his pay after disclosure of high executive pay became mandatory in Japan. Nissan Motor officials considered various ways to make up for the money Ghosn gave up, such as paying him consulting fees after retirement. They also mulled other methods such as payments through subsidiaries and stock options. Nothing had been paid at the time of the arrests. The contention is over whether that money should have been reported as compensation as a de facto promised sum under a binding contract, or didnÂ’t need to be disclosed until it was finalized. Ghosn has said a group at Nissan engineered his arrest because they feared that French automaker Renault, which owns 43% of Nissan, would gain more control over the company. Other Nissan officials made similar comments during KellyÂ’s trial. Renault sent Ghosn to Nissan in 1999 to lead its rescue from the brink of bankruptcy. He successfully steered the maker of the Leaf electric car and Infiniti luxury models for nearly two decades.

The Nissan Leaf has been declared the cleanest car in the US, and it's going to have a good case to claim the same title in Bhutan. Yes, Bhutan, the country famous for measuring Gross National Happiness is about to get serious about the EV Grin. Last December, we learned that Bhutan's capital city, Thimphu, wanted to build up a Leaf taxi fleet. That's when Renault-Nissan CEO Carlos Ghosn went to Bhutan to talk about the project and he has recently returned to deliver some vehicles to the Prime Minister of Bhutan, Tshering Tobgay, who has been advocating for EVs since taking office in July and has set a preliminary target of 2,000 EVs on the streets of Thimphu. Tobgay said his country, "will commit to a program to achieve zero emissions as a nation by a certain target date." It's not an outrageous goal for the Himalayan country, since it generates a lot of hydro-electric power, way more than it can use. There are only around 750,000 citizens of Bhutan and they only use five percent of the clean power made within its borders. Most of the rest goes to neighbor India. The problem, as expressed in Nissan's press release (available below), is that Bhutan takes "almost all of the revenue earned from selling electricity" to buy fossil fuel from India and power its national vehicle fleet. Over the past few months, we've talked a lot about how our long-term 2013 Nissan Pathfinder functions as a daily-driver, long-hauler and all-weather warrior. And so far, it's earning high praise from most of us for being a well-rounded, pleasant vehicle in these regards. But the vast majority of people who actually go out and buy a Pathfinder will do so because of its people-and-stuff-carrying abilities. Nissan specifically engineered the new Pathfinder to be a softer, more widely appealing crossover than the sort of rugged SUV that it was before, and in doing so, the company is hoping its new CUV will find homes in the garages of many American families.
We needed to get some family impressions of the new Pathfinder, and fast.
Thing is, many of us Autobloggers live the kid-free life - at least that's true of most of us in the Detroit area where the Pathfinder currently resides. We have no doubts that the Pathfinder will get a proper family road trip workout from west coast editor Michael Harley after it shuffles over to the left side of the country, and it might also do a jaunt to North Carolina this summer with executive editor Chris Paukert and his family before it leaves the area, but in the meantime, we needed to get some family impressions of the new Pathfinder, and fast.
