2011-2012 Nissan Leaf class-action lawsuit finally settled

In 2012, a group of Nissan Leaf owners sued the automaker in a class-action lawsuit over the "wilting Leaf" issue. That describes the steadily decreasing battery capacity of the electric vehicle's battery pack, which didn't line up with drivers' expectations. At the time, Nissan said the lawsuit was without merit but the legal wranglings continued. A new, $24-million settlement will give Leaf owners a new (not repaired) battery if their current pack drops down to fewer than nine bars of energy capacity. There are also options for 90 days of free charging at some of the No Charge To Charge locations or, if they don't live near any of those, a $50 check. One of the main complaints of the lawsuit was that the initial ads for the EV were less-than-clear, telling people the car could go 100 miles when fully charged but, and here's the problem, the automaker recommended that Leaf owners not charge their cars up all the way in hot climates. The class action suit was filed on behalf of Leaf owners in California and Arizona. It reads, in part: Before purchase or lease, Nissan failed to disclose its own recommendations that owners avoid charging the battery beyond 80% in order to mitigate battery damage and failed to disclose that Nissan's estimated 100 mile range was based on a full charge battery, which is contrary to Nissan's own recommendation for battery charging. Following early reports of the wilting problem in warm climates and the initial filing of the lawsuit, Nissan upgraded its battery warranty. It also improved the EV's battery chemistry. The class action suit says that it's this new chemistry that needs to go into any "wilting Leafs" that are affected by the suit. There's more information at the class-action site. Suspects in Ghosn's Japanese escape stand trial in Turkey

ISTANBUL - Seven suspects went on trial in Turkey on Friday over their alleged involvement in former Nissan boss Carlos Ghosn's dramatic escape from Japan to Lebanon via Istanbul at the end of last year. Ghosn, once a titan of the global auto industry, had been arrested in Japan in late 2018 and charged with underreporting his salary and using company funds for personal purposes, charges he denies. The ousted chairman of the alliance of Renault, Nissan Motor Co and Mitsubishi Motors Corp had been awaiting his trial under house arrest in Japan when he made a dramatic escape in December to Beirut, his childhood home. An executive from Turkish private jet operator MNG Jet and four pilots were detained in early January soon after Ghosn's escape and charged with migrant smuggling, a sentence carrying a maximum sentence of eight years in jail. They appeared in white protective overalls, masks and gloves as a measure against the coronavirus, as the court in Istanbul began hearing their defence. Two flight attendants, charged with failing to report a crime - a charge carrying a sentence of up to one year - were also there. The first defendant to speak was a pilot on the Osaka-Istanbul flight, Noyan Pasin, who denied the charge. Prosecutors, in their indictment, had said MNG Jet operations manager Okan Kosemen - who is one of the seven on trial - knew before the Osaka flight that Ghosn would be on board and would transfer to Beirut. Kosemen, who also pleaded not guilty, said in court on Friday he was only told via phone about Ghosn's presence mid-flight from Osaka and cooperated under duress. The prosecution said Kosemen used WhatsApp to communicate with pilots before, during and after the Osaka-Istanbul flight, using terms like "luggage" and "consignment" to refer to Ghosn. The five other suspects also deny the charges, according to the indictment. SAGA SHAKES AUTO WORLD According to the indictment, Kosemen told prosecutors a price of $175,000 was agreed for the flight with a Lebanese broker and paid into MNG Jet's bank account. At the time of the incident, MNG Jet said Kosemen acted without the knowledge of the company and it had filed a criminal complaint for the illegal use of its aircraft. Japan has formally asked the United States to extradite two Americans - a former Green Beret and his son - who also stand accused of helping Ghosn flee Japan. They were arrested in Massachusetts in May.

MILAN, Italy — When John Elkann lost his ally last year with the sudden death of Sergio Marchionne, some questioned whether the softly-spoken scion of the Agnelli clan would be able to emerge from his shadow to ensure Fiat Chrysler's future. But New York-born Elkann, who became Fiat chairman in 2010, acted decisively to fill the vacuum left by the larger-than-life Marchionne and get closer to the big merger deal the legendary executive was unable to deliver. At just 28, Elkann was thrust into the role of Fiat vice chairman after the deaths of his grandfather and great-uncle "because there was really nobody else" to take the wheel. For Elkann, who got his first taste of the car industry as an intern at a factory producing headlights in Birmingham, England, the first 18 months with responsibility for the family-owned carmaker and its long heritage were "terrible." But from that low point, Elkann, 43, is now trying to merge Fiat Chrysler (FCA) with French rival Renault to form the world's third largest carmaker and tackle new challenges facing the industry. Elkann will become chairman of the merged FCA-Renault if the deal goes ahead, ensuring the Agnelli dynasty plays a central role in the next chapter of automotive history. At an event in Milan on Monday, the usually-shy Elkann looked happy and confident. His first big break came with an instrumental role in persuading Marchionne, who was running one of the businesses owned by the Agnelli family, to become chief executive in 2004 and give Fiat "a new start," Elkann said in a "Masters of Scale" podcast last year. Fiat was at the time almost on the brink of collapse. This involved a "very long night ... and many grappas" but proved to be a turning point in the fortunes of the Italian company founded by Elkann's great-great-grandfather Giovanni Agnelli, which built its first car in 1899. In 2005, Elkann backed Marchionne in negotiating the breakup of an alliance Fiat had entered into with General Motors in 2000, receiving $2 billion from GM in return for canceling a deal that could have required GM to buy the remainder of Fiat Auto. Marchionne then used GM's money to fund a turnaround at Fiat, which involved taking the Italian carmaker into a transformation alliance and then full-blown merger with U.S. automaker Chrysler as Elkann agreed to the Agnellis loosening their grip.
