What to expect from the Japanese trial of Nissan and Greg Kelly

TOKYO — The criminal trial against Japanese automaker Nissan and its former executive Greg Kelly will open in Tokyo District Court on Tuesday. ItÂ’s the latest chapter in the unfolding scandal of Carlos Ghosn, a superstar at Nissan until he and Kelly were arrested in late 2018. Five questions and answers about the trial: Q: WHAT ARE THE ALLEGATIONS? A: The charges center around KellyÂ’s role in alleged under-reporting of GhosnÂ’s future compensation by about 9 billion yen ($85 million), a violation of financial laws. Kelly says he is innocent. Nissan, which is also similarly charged, has already acknowledged guilt, made corrections to the compensation documents submitted to the authorities, and has started paying a 2.4 billion yen ($22.6 million) fine. Q: WHAT HAPPENS TO GHOSN? A: Probably nothing. He skipped bail late last year and is now in Lebanon, which has no extradition treaty with Japan. Two Americans, Michael Taylor and his son Peter Taylor are being held in Massachusetts without bail, suspected of having helped Ghosn escape by hiding in a box on a private jet. A U.S. judge recently approved their extradition to Japan. The case is now before the U.S. State Department. Q: HOW DO CRIMINAL TRIALS PROCEED IN JAPAN? A: The trial, before a panel of three judges, is expected to take about a year. There is no jury. Juries are selected only for extremely serious cases in Japan, such as murder. In principle, there are no plea bargains although backroom deals are made all the time. Closed pre-trial sessions are held ahead of the trialÂ’s opening, often for months before the real trial begins. Japan's legal system has come under fire from both within and outside the country as “hostage justice” because suspects often are held for months and interrogated without a lawyer present, often leading to false confessions, according to critics. Q: WHAT ARE KELLYÂ’S CHANCES? A: More than 99% of criminal trials in Japan result in a conviction. Japanese Justice Minister Masako Mori, in an online presentation in English hosted by the Japanese Embassy in the U.S., argued the conviction rate is so high because Japan prosecutes only about a third of the cases that come up, choosing only those that “result in guilty verdicts.” She insisted there is a “presumption of innocence.” She declined comment on KellyÂ’s case.

Nissan Silvia smuggler faces maximum 20-year, $250k sentence

Thinking about trying to sneak a JDM car into the United States? Better think twice, because according to the Clarion-Ledger, one man in Mississippi has found himself in hot water for smuggling a Nissan Silvia into the country. Few details of the case are available, but the Silvia has a strong following among JDM enthusiasts despite (or perhaps because of) the fact that it was never officially sold Stateside. The low-slung coupe was offered in Japan and other markets from 1964 through 1968 and again from 1974 to 2002. Though it was powered principally with a four-cylinder engine, its front-engine/rear-drive layout made it popular on the tuning and drifting scenes. The 240SX that was offered Stateside was related, but not strictly speaking the same vehicle. It's likely because the Silvia was never certified for use on American roads (and because the culprit apparently didn't go through the correct channels) that the unidentified man in Ocean Springs, MS, is reportedly facing a $250,000 fine and up to 20 years in prison. Here's hoping whatever else he's got in the driveway is just as fast, because it looks like he'll have a lot of time to make up for. 2020 Colorado Winter Driver's Notes | Behind the Wheel S02 // E12

2020 Mercedes-AMG GLC 63 I’ve had bad luck with SUVs this winter. Especially performance ones. First, I got a 2019 Range Rover Sport SVR delivered on summers right as two feet of snow fell, rendering it undriveable. Then, coronavirus cancelled Easter Jeep Safari as well as my trip out to Moab in the 2020 Jeep Wrangler Rubicon Diesel. Thankfully, when this 469 horsepower luxury mall crawler was dropped off, the sun shone down and the snow (mostly) held off.  The first thing that I noticed was there were a few blank buttons throughout the cabin, something that you may see in an entry model vehicle, but IÂ’m not accustomed to seeing in an AMG. Not a great look for a vehicle with an $80,000 price tag. Thankfully that was where the disappointment ended. As soon as you press the start button, the engine fires up and the exhaust note is incredible. Hopping on the highway ramp near my house, I floored it, and the biturbo V8 had me pressed back into the driver's seat, and this wasnÂ’t even the S version that our staff drove last year. Inside and out, the GLC 63 was everything youÂ’d expect from Mercedes. The interior was immaculate, and while the infotainment wheel and touch pad may take some getting used to for someone who isnÂ’t familiar, by now I have it down so that I can use it without looking. And while the V8 left me smiling ear to ear, I was most impressed by the amount of useable interior space there is. I happened to be moving at the time of this review and while all of my large furniture was shoved into the back of a moving van, I was able to fit almost everything else in the back of the GLC. 2019 and 2020 Fiat 500X Trekking ItÂ’s hard to say goodbye to an AMG and then turn around and be excited when a Fiat 500X pulls in your driveway (I know, I know, automotive journalist problems). That being said, when the red Fiat pulled up, I found myself admiring it. I am very familiar with the 500X. Back in 2016 Autoblog had one for a year as our long term test vehicle. I drove that car everywhere, multiple trips up north in Michigan, and even tracked it at Gingerman Raceway for a few laps before the brakes started smoking.  The 2019 model I had in my driveway and the 2020 model I drove in the snow up in the mountains feel very similar to that car. The interior is stylish and surprisingly roomy. The greenhouse is airy.
