2013 Nissan Pathfinder: February 2013

I took the keys to our long-term 2013 Nissan Pathfinder from Editor-in-Chief Neff (who left me with an empty gas tank, for the record) directly following the Detroit Auto Show. That means that, by the time you all read this, I'll have been in possession of the Pathfinder for more time, and driven it more miles than any Autoblogger so far. I'd like to think that I've made good use of it... with one small exception.
For those of you that live outside of the Snow Belt and who may routinely ignore the Weather Channel out of cocky certainty - I'm looking at you, American Southwest - there's been some real weather in our part of the world this winter. A year ago, I'd basically packed up my shovel and my driveway salt by Valentine's Day; while the last quarter of 2012 and beginning of 2013 have seen back-wrenching piles of snow fall on and around my Michigan home. Good times, in other words, to test the all-weather capabilities of our all-wheel-drive Pathfinder.

Carlos Ghosn's wife appeals to President Trump to help her husband

LONDON — The wife of former Nissan chairman Carlos Ghosn urged U.S. President Donald Trump to raise her husband's case with Japan's prime minister at a summit of world leaders later this month. "I'd like President Trump to speak to Prime Minister Abe about fair conditions, fair trial conditions and to let me speak to my husband and also to respect this presumption of innocence until proven guilty," Beirut-born Carole Ghosn, who has a U.S. passport, told the BBC. Shinzo Abe is due to host other leaders of the Group of 20 economies in the Japanese city of Osaka on June 28-29. In April Carole Ghosn called on the French government to do more to help her husband. Carlos Ghosn, who holds French, Lebanese and Brazilian citizenship, is facing financial misconduct charges and has said he is the victim of a boardroom coup, accusing "backstabbing" former colleagues of conspiring to oust him as Nissan chairman. Carole Ghosn said she had not spoken to her husband since he was re-arrested on April 4 before being released on bail three weeks later. "They told him one of the bail conditions, the restrictions, is he isn't allowed to speak to me or talk to me, which I find inhumane," she said. "All of this could have been dealt with internally within the company. This didn't need to go this far and on top of it my husband is innocent and time will prove the truth." Carlos Ghosn, a year after arrest, still seeks trial date and access to evidence

TOKYO — A year after his arrest, Nissan ex-Chairman Carlos Ghosn remains stuck in Tokyo under stringent bail conditions and without a trial date as he seeks access to a trove of Nissan emails and other evidence to fight charges of financial misconduct. His lawyers have asked a court to grant access to 6,000 pieces of evidence collected from Nissan such as electronic communications, which they say is crucial for a fair trial, showed an Oct. 4 court filing seen by Reuters. The once-feted executive has spent 129 days in detention since his arrest shortly after his private jet touched down at a Tokyo airport on Nov. 19, 2018. He faces four charges — which he denies — including hiding income and enriching himself through payments to dealerships in the Middle East. Nissan sacked Ghosn, saying its internal investigations revealed misconduct ranging from understating his salary while he was its chief executive, and transferring $5 million of Nissan funds to an account in which he had an interest. An earlier court ruling allowed prosecutors to hand back evidence to Nissan during pretrial wrangling over witnesses and evidence similar to the U. S. discovery process. If prosecutors are "given the freedom to unilaterally delete the collected evidence and return it to relevant parties, this is equivalent to granting the investigative agencies the right to destroy evidence," showed the filing to the Tokyo District Court. The lawyers also asked the court to rescind the earlier ruling, saying some evidence could be erased by Nissan to protect confidential business information. They argued the "ruling deprives Mr. Ghosn of his right to receive a fair public trial by an impartial court," as it enabled prosecutors to view and use the evidence and withhold it from the defense. Prosecutors are not required to hand over all evidence they or the police gather during investigations unless ordered by the court, unlike in the U.S. discovery process where prosecutors and defense lawyers disclose the evidence they intend to present in court. A spokeswoman for the Tokyo prosecutors' office said the office could not comment on individual cases. A Nissan spokeswoman declined to comment. Ghosn's lawyers have also asked the court to dismiss all charges against him, accusing prosecutors of colluding with government officials and Nissan executives to oust him to block any takeover of the automaker by French alliance partner Renault SA, of which Ghosn was also chairman.
