What to expect from the Japanese trial of Nissan and Greg Kelly

TOKYO — The criminal trial against Japanese automaker Nissan and its former executive Greg Kelly will open in Tokyo District Court on Tuesday. ItÂ’s the latest chapter in the unfolding scandal of Carlos Ghosn, a superstar at Nissan until he and Kelly were arrested in late 2018. Five questions and answers about the trial: Q: WHAT ARE THE ALLEGATIONS? A: The charges center around KellyÂ’s role in alleged under-reporting of GhosnÂ’s future compensation by about 9 billion yen ($85 million), a violation of financial laws. Kelly says he is innocent. Nissan, which is also similarly charged, has already acknowledged guilt, made corrections to the compensation documents submitted to the authorities, and has started paying a 2.4 billion yen ($22.6 million) fine. Q: WHAT HAPPENS TO GHOSN? A: Probably nothing. He skipped bail late last year and is now in Lebanon, which has no extradition treaty with Japan. Two Americans, Michael Taylor and his son Peter Taylor are being held in Massachusetts without bail, suspected of having helped Ghosn escape by hiding in a box on a private jet. A U.S. judge recently approved their extradition to Japan. The case is now before the U.S. State Department. Q: HOW DO CRIMINAL TRIALS PROCEED IN JAPAN? A: The trial, before a panel of three judges, is expected to take about a year. There is no jury. Juries are selected only for extremely serious cases in Japan, such as murder. In principle, there are no plea bargains although backroom deals are made all the time. Closed pre-trial sessions are held ahead of the trialÂ’s opening, often for months before the real trial begins. Japan's legal system has come under fire from both within and outside the country as “hostage justice” because suspects often are held for months and interrogated without a lawyer present, often leading to false confessions, according to critics. Q: WHAT ARE KELLYÂ’S CHANCES? A: More than 99% of criminal trials in Japan result in a conviction. Japanese Justice Minister Masako Mori, in an online presentation in English hosted by the Japanese Embassy in the U.S., argued the conviction rate is so high because Japan prosecutes only about a third of the cases that come up, choosing only those that “result in guilty verdicts.” She insisted there is a “presumption of innocence.” She declined comment on KellyÂ’s case.

Nissan shows how EVs are breaking the niche barrier in Norway

Call it Keeping up with the Hansens. Through a combination of environmental consciousness, big-time government incentives and good old-fashioned peer pressure, Norway has become the country with the highest number of electric vehicles per capita. And Nissan couldn't be happier. EVs have about a 15-percent new-vehicle market share in Norway, Nissan says in a new four-minute video called No Longer Niche (watch it below). Between Norway's cheap electricity and incentives such as bus-lane use, free parking and free public recharging, Nissan's sold more than 15,000 of its all-electric Leaf EVs since sales started in Norway in 2011. In fact, Norway's EV incentives were scheduled to run through 2017, but the rules' 50,000-EV threshold may be reached as soon as next year. The rising (and, we suspect, somewhat frigid) EV tide has helped other vehicle makers, to a lesser extent. This past spring, The Wall Street Journal reported that Tesla Motors' all-electric Model S sold almost 1,500 units in March, breaking the all-time single-model monthly sales record for the country. To put EVs' 15-percent market share in perspective, consider this: last year, Ford F-Series pickups, the biggest-selling US model, accounted for about five percent of US new vehicle sales. Recharge Wrap-up: BMW Next 100 video, how Nissan "tops off" battery

BMW explains the ideas behind its Vision Next 100 concept car that debuted at the Geneva Motor Show. As BMW celebrates its 100th birthday, it wants to look into the future rather than dwell on its past. This involves the digital and analog worlds working together "to create a seamless experience." Hence the "live geometry," wherein physical parts of the car move to translate digital information to the driver. The video also gets into the future of driving modes, like "Ease," for more autonomous driving, and "Boost," for when the driver wants to take control to enjoy some motoring the good, old-fashioned way. The automaker has found that after a full charge, one can wait a few minutes for subsequent "minicharges" to "top off" the battery. The voltage dips slightly, much as the foam does on a pint of beer, allowing the battery to accept some more juice. The result is an extra 0.7 percent of energy, which could mean just enough extra range to reach the next charging station. Read more from Automotive News. Hyundai has delivered its first Tucson Fuel Cell in Ontario, Canada. The lucky recipient is Joseph Cargnelli, Chief Technology Officer of Hydrogenics Corporation, a company based on hydrogen technology. Toyota has entered a public-private partnership to test an end-to-end hydrogen supply chain in Japan. The collaboration with the Kanagawa Prefectural Government, the municipal governments of the cities of Yokohama and Kawasaki and three private companies to create renewable hydrogen to power forklifts. It will use wind energy to electrolyze hydrogen, which will then be shipped to a factory, a vegetable and fruit market and two warehouses to be used in the fuel cell-powered vehicles. This supply chain is expected to reduce CO2 emissions by 80 percent compared to traditionally fueled forklifts. Read more from Toyota.
