Carlos Ghosn changes to hotshot attorney and a new defense strategy

TOKYO — Carlos Ghosn's chief defense attorney Motonari Otsuru resigned and was replaced by a team that includes hotshot lawyer Junichiro Hironaka, in a change of strategy from the ousted Nissan Motor chairman three months after his arrest. Ghosn, Nissan's one-time savior, has been held in detention since his Nov. 19 arrest. He's been indicted and accused of under-reporting his salary and breach of trust. He has denied the charges. The once-feted auto executive hired Hiroshi Kawatsu as head of a new defense team, his office said on Wednesday. Hironaka, 73, has won several high profile cases, helping acquit senior lawmaker Ichiro Ozawa and senior bureaucrat Atsuko Muraki. Hiring Hironaka would mean a more aggressive legal strategy, said Nobuo Gohara, a former prosecutor. Otsuru previously led the special prosecutors' office that is now handling Ghosn's case. "Otsuru was miscast. He worked at the heart of the special prosecutors office so he was not someone who was going to go after them aggressively," Gohara said. "Hironaka is an experienced defense lawyer who has won a number of cases. He will mount a more thorough and aggressive defense." Otsuru's office confirmed his resignation in a statement, but gave no reason for the move. A second member of Ghosn's defense team, Masato Oshikubo, had quit, it said. Go Kondo, Ghosn's third defense lawyer, was unavailable for comment. Ghosn released a short statement thanking Otsuru for his team's "tireless and diligent work," and called him a "very capable and intelligent man and lawyer." The sudden change in attorneys comes ahead of the expected start of informal meetings with prosecutors and judges to discuss pretrial preparations, an indication that there will be no new charges against Ghosn. "As we begin the trial phase, I have decided to engage Hironaka-sensei as my legal counsel," Ghosn said, using an honorific suffix. "I look forward to defending myself vigorously, and this represents the beginning of the process of not only establishing my innocence but also shedding light on the circumstances that led to my unjust detention." Ghosn, 64, told the Nikkei newspaper last month that Nissan executives opposed to his plans for closer ties with automaking partner Renault SA had plotted to remove him. Ghosn was widely credited with rescuing Nissan from near-bankruptcy after he was brought over to Japan in 1999 by Renault after the French automaker bought a chunk of Nissan.

Nissan owners complain to feds about rusting floors

"You can feel it's soft right here," Jeff Talman told KSHB. "Right under his driver and passenger seats, the floorboards were rusting from the inside out," a KSHB reporter said. "This is a seven-inch area where it's actually rotted up here," Talman said. That was Jeff Talman, just one of many who have had issues with rusting floorboards in Nissan Altimas. KSHB reported the National Highway Traffic Safety Administration has received more than 400 complains about rust issues in 2002-2006 models. NBC highlighted a Chicago woman's 2005 car, which had rusted so much the floorboards were actually crumbling. "The hole was big enough to fit her foot through," NBC reporter Tom Costello said. "I'm not Fred Flintstone. This is not a good thing," Marie DeMaria said. While NBC reports snow and road salt could account for rust damage in some vehicles, that's probably not the cause in places that don't get snow and ice. And complaints are coming in from all over the country. Both Toyota and Ford have recalled hundreds of thousands of vehicles in the past few years because rusting underbody parts made the vehicles fall apart. Despite the number of complaints, Nissan isn't recalling the Altima vehicle models in question. "It's not a safety recall problem that's going to cause immediate death and injury if you have a hole in the floor. As a result of that, what we've seen is that Nissan has been able to get away with this problem," auto safety expert Sean Kane told WBZ-TV. KSHB reports the age of the cars is another way Nissan is able to avoid covering cost to fix them. "Once it's out of the warranty period, obviously they don't have any legal obligation. It becomes more of a customer service issue of whether they want to deal with it or not," body shop owner Bill Eveland said. NBC did reach out to Nissan for comment, but the carmaker reiterated that both it and the National Highway Traffic Safety Administration do not consider the rust problem to be a safety defect. Nissan expands, shrinks Leaf recall for missing weld points

Chalk this one up to the quirks of the English language. The other day, we had a post on the recall of a small number of 2014 Nissan Leaf EVs that were missing weld spots. The official bulletin from the National Highway Traffic Safety Administration said that "any vehicle missing welds will be replaced, free of charge." We read that as saying that the welds would be replaced, but in fact it's the cars themselves that will be swapped out. NHTSA said that 211 Leafs were potentially involved in this recall, but we heard from Brian Brockman, Nissan's senior manager of corporate communications, that Nissan is actually looking at, "approximately 276" vehicles. More importantly, Brockman clarified that, "If a vehicle is found to be missing the welds, the entire vehicle will be replaced." NHTSA documents on Inside EVs show that Nissan expects just 0.65 percent of those Leafs will need to be replaced. Brockman wouldn't say exactly how many cars Nissan thinks are affected, but 0.65 percent of 276 is just 1.8 vehicles. Brockman did say that, "you'd be correct to say that we expect the number to be very low." Read Nissan's full statement below. Nissan is conducting a Voluntary Recall Campaign on approximately 276 MY2014 LEAF vehicles to inspect the front member assembly welds. Due to an isolated supplier process error that has been corrected, a small number of vehicles within a subset of MY2014 LEAF vehicles manufactured during a two-week period may have front frame member assembly components that were not welded to proper specification. This can affect crash performance. Within the next few weeks, affected LEAF owners will be asked to bring their vehicle to a certified Nissan LEAF dealer for an inspection. If the vehicle is determined to be affected, Nissan will provide owners with a brand new replacement vehicle at no additional cost. A loaner vehicle will be provided during the vehicle exchange process. It is anticipated that only a handful of retailed vehicles are affected by the weld issue and require vehicle replacement.
