Carlos Ghosn sues Nissan-Mitsubishi in the Netherlands

AMSTERDAM — Carlos Ghosn has launched a court case in the Netherlands against Japanese carmakers Nissan Motor and Mitsubishi Motors, who ousted him as chairman of their alliance last year on charges of embezzlement, Dutch newspaper NRC reported on Saturday. Ghosn is seeking 15 million euros ($16.8 million) in damages from the carmakers, as grave mistakes were made when he was sacked, NRC reported, citing his lawyer. "In the Netherlands, if you want to fire an executive you have to first tell him what he's being accused of, and you have to provide him with the evidence for the accusations. Neither of those things has happened," lawyer Laurens de Graaf told NRC. Ghosn fell from grace late last year when he was arrested in Japan and sacked by Nissan on charges of financial misconduct, which he denies. He has also been fired as the CEO and chairman of French carmaker Renault. Ghosn was freed in April from jail in Japan on a $4.5 million bail. Among other charges of fraud and misconduct, Nissan and Mitsubishi have said Ghosn improperly received $9 million in compensation from their joint venture. Suspect expenses Ghosn made when he chaired Renault and Nissan amounted to about 11 million euros, Renault's board said in June. Ghosn holds French, Lebanese and Brazilian citizenship, but opted for the fiscally more friendly Netherlands as his tax domicile in 2012. The holding company for the Nissan-Mitsubishi alliance is also incorporated in the Netherlands. The district court in Amsterdam is reviewing the case but has not set a trial date yet, NRC said. Mitsubishi Outlander rumored to get Nissan engine, Rogue Sport to get PHEV

A report in the Japanese business daily Nikkei, picked up by Automotive News, said Mitsubishi anticipates using a Nissan engine in the next-generation Outlander headed our way later this year. If the report comes true, the engine swap would be a first for the Renault-Nissan-Mitsubishi alliance partners outside of Japanese kei cars. Mitsubishi engineers will have an easier time slotting in a Nissan engine as the next-gen Outlander gives up its GS platform — an architecture Mitsubishi co-developed with Daimler Chrysler almost 20 years ago — to move to a modified version of the CMF platform that supports the Nissan Rogue and Qashqai, our Rogue Sport.    Last December, Auto Express spoke to Ponz Pandikuthira, NissanÂ’s European vice president of product planning. The exec said Nissan had two hybrid powertrains under consideration for the next-generation Qashqai, the first being Nissan's serial hybrid ePower system that's fared well in Japan where overall speeds are low, but that might not be suited to Europe's higher average speeds. As for a PHEV, Pandikuthira said, "WeÂ’re not pursuing a big plug-in hybrid strategy. On some car lines weÂ’ll try it out, but the business case for plug-in hybrids is not very good." Completing the round-turn, Nikkei said Mitsubishi would supply its PHEV for the compact Nissan, making the Qashqai the car line that gets the tryout. If that happens, and assuming Nissan brings it here, the Rogue Sport would be Nissan's first PHEV in the U.S. Nissan has tended to delay updating the Rogue Sport to Qashqai spec, so depending on when a PHEV version arrives, it could be the only hybrid in Nissan's U.S. fleet since the Rogue Hybrid retired for the 2020 model year.  The platform and engine exchange would have been planned before Nissan's troubles over the past 18 months, but they represent the alliance's growing effort for greater synergy and lower costs. One supposed tactic going forward comes from the Volkswagen Group playbook, identifying a brand's expertise and putting the brand in charge of developing that expertise for the alliance, the same way the Volkswagen brand develops low-cost platforms and Audi runs R&D for the group. Another class cut-up has graduated from our motor pool. The Nissan Cube's indefatigable weirdness was likely both its chief selling point and its Achilles Heel, but Autoblog sources say that after a six-year run in the US, the niche player has been scrubbed from the Japanese automaker's lineup.
The move is hardly unexpected - there was confirmation from Nissan Canada that it was pulling the plug on the asymmetric little front-driver in its market back in May, and sales have not exactly been sparkling here in the States, either. In June, Nissan shifted just 336 Cubes, down 23.8 percent year over year. So far this year, Nissan has sold 2,294 units, a sales pace off 30.9 percent versus 2013. At its peak in 2010, the Cube remained firmly a niche vehicle, selling 22,968 units.
Nissan North America's Dan Passe, senior manager of product communications, maintains that "We are continuing to sell the 2014 Cube and we haven't made an announcement about future model plans," but Autoblog sources indicate that an official announcement will be coming in the next couple of months, and the Cube has been conspicuously left off of an exhaustive 2015 lineup "Charting the Changes" announcement released on Tuesday.
