Nissan files civil suit against Ghosn, seeking $91 million in damages

TOKYO — Nissan filed a civil suit Wednesday seeking 10 billion yen ($91 million) in damages from the Japanese automaker's former Chairman Carlos Ghosn. Nissan filed the case in Yokohama District Court to recoup some of the monetary damages suffered, it said, “as a result of years of misconduct and fraudulent activity" by Ghosn. The claim was calculated by adding the costs from what Nissan called Ghosn's “corrupt practices,” such as rent for overseas property, use of corporate jets and payments to Ghosn's sister, as well as costs for the internal investigation into Ghosn's alleged wrongdoings. Representatives of Ghosn said in a statement they couldn't comment as they had yet to see the legal documents. “Nissan's maneuvers continue,” they said, while noting Nissan had claimed larger damages before. Ghosn, who led Nissan for two decades and saved it from near-bankruptcy, was arrested in Japan in November 2018, and charged with underreporting his future compensation and breach of trust in diverting Nissan money for personal gain. He was awaiting trial but skipped bail and showed up in Lebanon late last year. Japan has no extradition treaty with Lebanon, and he's unlikely to be arrested. A date had not been set for his trial, and Ghosn has said he was worried his ordeal would never end and he would not get a fair hearing. The bail conditions also barred him from seeing his wife. He has repeatedly lashed out at Japan's judicial system, where the conviction rate is higher than 99%. Japanese authorities recently issued an arrest warrant for Ghosn and three Americans, accused of helping his escape. Separately, they issued an arrest warrant for Ghosn's wife on suspicion of perjury. Ghosn has repeatedly said he is innocent, saying that the promised compensation had never been decided, and all the payments were for legitimate services. Wednesday's lawsuit by Nissan comes on top of the civil case Nissan filed against Ghosn in the British Virgin Islands in August last year. It alleged unauthorized payments, sought to regain a luxury yacht and pursued other damages, according to Nissan. Yokohama-based Nissan, which makes the Z sportscar, Leaf electric car and Infiniti luxury models, is also facing trial in Japan as a company in relation to Ghosn's scandal. It has indicated it will agree to any penalties. Nissan's reputation has been sorely tarnished over the Ghosn fiasco, and its sales have dropped. Nissan reports financial results Thursday.

Infiniti previews four upcoming models on its path to electrify by 2030

Nissan and Infiniti have been “also ran” automakers for years, but a shift to electrification presents new opportunities to break through the noise and climb back up the sales charts. To get there, Infiniti is looking at a range of new models in body styles familiar and futuristic. The luxury automaker recently announced four new models that it said will lead its transformation to an all-electric company by 2030. The concepts have familiar shapes with futuristic touches that donÂ’t appear in the automakerÂ’s current lineup. InfinitiÂ’s Vision Qe concept illustrates its vision of the modern sedan, with a striking fastback shape and unique lighting elements that give it a real Tron vibe. Similarly, the brandÂ’s QXe concept blends that styling philosophy with advanced tech and a crossover body style. Infiniti also previewed its new QX80 flagship SUV, scheduled to arrive in 2024. The automaker previewed its upcoming luxury three-row with the QX Monograph concept earlier this year at Pebble Beach, and the new model looks to be a refinement of the existing SUVÂ’s boxy, upright shape. Infiniti said the cabin will feature upscale materials and high-end tech that elevate the experience. Finally, the QX65 is a new midsize crossover coupe that Infiniti said will channel its FX crossovers from years ago. The automaker promised the new SUV would be a “stylish two-row alternative in the cluttered midsize crossover segment.” Infiniti didnÂ’t show a closeup of the vehicle, but we can get a hint from the teaser image, which displays a small crossover with seeping lines and a unique roofline. Infiniti and parent company Nissan have work to do before they are anywhere near level with their rivals, but they havenÂ’t been able to capitalize on missteps by others, including the fact that heavy-hitters Toyota and Honda have been slow to move on electrification. NissanÂ’s Ariya saw significant delays and landed well after its intended release date, losing what could have been an impressive early mover advantage. Nissan owners complain to feds about rusting floors

"You can feel it's soft right here," Jeff Talman told KSHB. "Right under his driver and passenger seats, the floorboards were rusting from the inside out," a KSHB reporter said. "This is a seven-inch area where it's actually rotted up here," Talman said. That was Jeff Talman, just one of many who have had issues with rusting floorboards in Nissan Altimas. KSHB reported the National Highway Traffic Safety Administration has received more than 400 complains about rust issues in 2002-2006 models. NBC highlighted a Chicago woman's 2005 car, which had rusted so much the floorboards were actually crumbling. "The hole was big enough to fit her foot through," NBC reporter Tom Costello said. "I'm not Fred Flintstone. This is not a good thing," Marie DeMaria said. While NBC reports snow and road salt could account for rust damage in some vehicles, that's probably not the cause in places that don't get snow and ice. And complaints are coming in from all over the country. Both Toyota and Ford have recalled hundreds of thousands of vehicles in the past few years because rusting underbody parts made the vehicles fall apart. Despite the number of complaints, Nissan isn't recalling the Altima vehicle models in question. "It's not a safety recall problem that's going to cause immediate death and injury if you have a hole in the floor. As a result of that, what we've seen is that Nissan has been able to get away with this problem," auto safety expert Sean Kane told WBZ-TV. KSHB reports the age of the cars is another way Nissan is able to avoid covering cost to fix them. "Once it's out of the warranty period, obviously they don't have any legal obligation. It becomes more of a customer service issue of whether they want to deal with it or not," body shop owner Bill Eveland said. NBC did reach out to Nissan for comment, but the carmaker reiterated that both it and the National Highway Traffic Safety Administration do not consider the rust problem to be a safety defect.
