Feds say Americans' bid to avoid extradition in Ghosn escape is 'flawed'

BOSTON — U.S. prosecutors on Tuesday said a former Green Beret and his son, wanted by Japan for helping former Nissan boss Carlos Ghosn flee the country, were advancing a "flawed" interpretation of Japanese law to fight their extradition. Michael Taylor and his son, Peter Taylor, were arrested in Massachusetts last month at Japan's request for allegedly smuggling Ghosn out of the country on Dec. 29, 2019, in a box while he was out on bail awaiting trial on financial charges. Ghosn fled to Lebanon, his childhood home, after being charged with engaging in financial wrongdoing, including by understating his compensation in Nissan's financial statements. He denies wrongdoing. Lawyers for the Taylors in a motion last week asked a federal judge in Boston to quash the provisional warrants issued in May for their arrests, arguing that "bail jumping" is not a crime in Japan. Defense lawyers argued that helping someone jump bail was also not a crime. While Japan issued arrest warrants for the Taylors in January, the lawyers said the crime stated in the warrants is an immigration offense and a non-extraditable misdemeanor. But U.S. prosecutors in a brief filed on Tuesday said it would be "unprecedented" for the extradition case at this junction to be tossed based on a "flawed interpretation of Japanese law and a mischaracterization of the facts." While Japan has not yet formally sought their extradition, the country has confirmed that Taylors' conduct constitutes a felony, U.S. prosecutors said. "The purported loophole through which the Taylors seek to evade justice simply does not exist," U.S. prosecutors wrote. Prosecutors added that neither Taylor, including Michael, a U.S. Army Special Forces veteran and private security specialist, should be released from jail as they are flight risks. Japan minister launches counterattack after Ghosn blasts justice system

TOKYO — Japan's justice minister launched a rare and forceful public takedown of auto executive-turned-fugitive Carlos Ghosn after he blasted the country's legal system as allowing him "zero chance" of a fair trial as he sought to justify his escape to Beirut. After his dramatic flight to Lebanon last month, Ghosn spoke in public for the first time on Wednesday, saying he had been treated "brutally" by Tokyo prosecutors. He said they questioned him for up to eight hours a day without a lawyer present and tried to extract a confession out of him. In an effort to undo Ghosn's attempt to sway public opinion in his favor, Justice Minister Masako Mori followed shortly with a statement, translated into English and French, and held a news conference after midnight and again around 9:30 a.m. on Thursday morning to defend Japan's justice system. "I decided to do this because defendant Ghosn was looking to justify his unlawful exit from Japan by propagating a false recognition of our justice system," she said at the second news conference. "I felt that we needed to respond immediately to broadcast a correct understanding to people around the world." Ghosn, the former chief of Nissan and Renault, fled Japan last month as he was awaiting trial on charges of under-reporting earnings, breach of trust, and misappropriation of company funds, all of which he denies. Mori said Ghosn's escape from his trial in itself "could constitute a crime" that would not be tolerated in any country. "My impression in listening to him was that there were few statements that were backed by any real evidence," she said. "If he wants to prove his innocence, he should face fair trial proceedings here," she added, stressing that the allegations against him concerned financial crimes in Japan. "That would be the mark of a first-class businessperson and good citizen." Mori blasted Ghosn for violating his bail by fleeing the country "without showing a passport and breaking international rules that everyone in the world follows." "It was a breach of faith that can't be explained to our children," she said. The spotlight on Japan's justice system comes as Mori is set to host in April the United Nations' Congress on Crime Prevention and Criminal Justice, held once every five years.

The Northwest Automotive Press Association (NWAPA) has given the Lexus CT 200h its Favorite Hybrid title. It named the compact luxury hybrid its favorite of 2014 at its Drive Revolution in Portland (where it also named the new Volkswagen Golf TDI the Northwest Green Car of the Year). According to NWAPA president Nik Miles, the CT 200h earned the honor for "impressive combination of state-of-the-art small car luxury and hybrid technology." For 2014, the Lexus CT200h got an updated front end, including the spindle grille we've been seeing on new Lexus vehicles, plus a redesigned steering wheel and sliding sun visors. Chevrolet started including stop-start technology standard in Malibus equipped with the four-cylinder engine. Chevy has sold about 83,000 of that model, so 97 percent of 2014 and 2015 Malibu sales include stop-start. Now, that technology has made its way into the 2015 Impala. With drivers idling an average of 16 minutes a day, stop-start can significantly reduce harmful emissions and save fuel. Nissan Leaf customers in Los Angeles will get access to free charging beginning August 15. Nissan is extending its "No Charge to Charge" promotion to LA, which will allow customers to charge at public charging stations at no cost. Leaf customers - including those who bought or leased their car from the participating dealerships on or after July 1 - will get an EZ-Charge card, allowing them to use ChargePoint, Blink, CarCharging, AeroVironment and NRG eVgo chargers for free. Rapid chargers can charge the Leaf's battery to 80 percent in 30 minutes. Nissan plans to offer the "No Charge to Charge" in at least 14 more markets in the US, bringing the total to 25, within the next year. See the press release below for more details. California will get six all-electric school buses for three school districts as part of a demonstration program. The California Energy Commission awarded a grant of $1.4 million for the program to National Strategies LLC; this is in addition to a $2.2-million grant from the South Coast Air Quality Management District. The EV buses use vehicle-to-grid technology, allowing them to sell energy back to the grid when it is needed.
