Carlos Ghosn: What misconduct is he accused of?

TOKYO — Japan was shocked by news that Nissan Motor Co. Chairman Carlos Ghosn, who was widely respected for rescuing the carmaker from near bankruptcy, was arrested on Monday for alleged financial misconduct. Nissan said that Ghosn, who is also chairman and CEO of Renault and chairman of Mitsubishi Motors, would be fired from his post as Nissan chairman on Thursday. What is Carlos Ghosn accused of? Nissan CEO Hiroto Saikawa told a packed press conference on Monday night that the company had found that Ghosn had been using corporate money for personal purposes and under-reporting his income for years in official company filings to the Tokyo Stock Exchange. Another board member, Greg Kelly, was also deeply involved in the misconduct, Nissan said. Saikawa said he couldn't elaborate as the cases are being investigated by prosecutors, who have declined to comment. Prosecutors said that Ghosn and Kelly conspired to understate Ghosn's compensation over five years starting in fiscal 2010 as being about half of the actual 9.998 billion yen ($88.9 million). Public broadcaster NHK said Nissan paid billions of yen to buy and renovate homes for Ghosn in Rio, Beirut, Paris and Amsterdam, citing unnamed sources. The properties had no business purpose and were not listed as benefits in TSE filings, NHK said. Ghosn, 64, has not been formally charged. The Asahi newspaper reported that he and Kelly had submitted to prosecutors' questions after getting off a plane on Monday afternoon at Tokyo's Haneda Airport. Saikawa confirmed they had been arrested. Ghosn and Kelly have not been seen since, and their exact whereabouts are not known. Suspects are typically taken to the Tokyo Detention Center, which is linked to the Tokyo District Public Prosecutors Office. How did this come to light? Nissan's Saikawa said Ghosn's alleged improprieties came to light through a whistleblower, after which the company began an internal investigation and informed prosecutors. Japanese media reports say the informant is a member of Nissan's legal department. The Asahi reported, without citing sources, that the informant gave the prosecutors information in a plea bargain, implying the person may have provided evidence in exchange for a lighter sentence. Nissan gets new NA boss, lowered forecasts in management shakeup

José Muñoz, a Nissan and Infiniti sales and marketing vice president, will replace Colin Dodge as Nissan's new North America chief, come Jan. 1, as part of a wide-ranging management shuffle, Automotive News reports. Dodge will remain on Nissan's board, be assigned to special projects and report directly to CEO Carlos Ghosn.
Nissan is working on reorganizing its global operations into six regions, each with a new chief: North America (Muñoz' territory), Latin America, Japan-Southeast Asia, China, Europe and Africa-India-Middle East. Currently Nissan divides the globe into three regions, the Americas, Europe-Africa-India-Middle East and Asia-Pacific.
Nissan also lowered its sales forecast from 5.3-million vehicles to 5.2 million for the fiscal year ending on March 31, 2014. Last year, the company sold 4.914 million in the same period. In May, after Nissan's market share had fallen to 7.7 percent, Ghosn said he wants to double sales in the US by 2017 and increase its market share in the country to 10 percent.

That would be the Nürburgring, of course, where automakers trade bragging rights like baseball cards - only they don't give them up willingly. Renault set the front-drive lap record in 2008 with the previous Mégane R26.R then set the bar even higher with the Mégane RS 265 Trophy. That was before Seat stole the honors with its Leon Cupra 280, only for Renault to take them back again with the Mégane RS 275 Trophy-R. Seat is rumored to be considering a renewed assault, but it won't be the only one nipping at Renaultsport's heels in the coming years.
Honda, for its part, has made no secret of its ambition to set the record with the upcoming Civic Type R, and now word has it that Nissan is planning an assault of its own. Its weapon of choice would be an upcoming Nismo version of the new Pulsar hatchback which is just hitting the European market now as a rival to the Ford Focus, Volkswagen Golf, et al. There's no word on what its specs would be, but if it's going to challenge these players, it's going to need between 270 and 300 horsepower, a stiff suspension, big brakes and probably some sort of trick differential.
