Suspects in Ghosn's Japanese escape stand trial in Turkey

ISTANBUL - Seven suspects went on trial in Turkey on Friday over their alleged involvement in former Nissan boss Carlos Ghosn's dramatic escape from Japan to Lebanon via Istanbul at the end of last year. Ghosn, once a titan of the global auto industry, had been arrested in Japan in late 2018 and charged with underreporting his salary and using company funds for personal purposes, charges he denies. The ousted chairman of the alliance of Renault, Nissan Motor Co and Mitsubishi Motors Corp had been awaiting his trial under house arrest in Japan when he made a dramatic escape in December to Beirut, his childhood home. An executive from Turkish private jet operator MNG Jet and four pilots were detained in early January soon after Ghosn's escape and charged with migrant smuggling, a sentence carrying a maximum sentence of eight years in jail. They appeared in white protective overalls, masks and gloves as a measure against the coronavirus, as the court in Istanbul began hearing their defence. Two flight attendants, charged with failing to report a crime - a charge carrying a sentence of up to one year - were also there. The first defendant to speak was a pilot on the Osaka-Istanbul flight, Noyan Pasin, who denied the charge. Prosecutors, in their indictment, had said MNG Jet operations manager Okan Kosemen - who is one of the seven on trial - knew before the Osaka flight that Ghosn would be on board and would transfer to Beirut. Kosemen, who also pleaded not guilty, said in court on Friday he was only told via phone about Ghosn's presence mid-flight from Osaka and cooperated under duress. The prosecution said Kosemen used WhatsApp to communicate with pilots before, during and after the Osaka-Istanbul flight, using terms like "luggage" and "consignment" to refer to Ghosn. The five other suspects also deny the charges, according to the indictment. SAGA SHAKES AUTO WORLD According to the indictment, Kosemen told prosecutors a price of $175,000 was agreed for the flight with a Lebanese broker and paid into MNG Jet's bank account. At the time of the incident, MNG Jet said Kosemen acted without the knowledge of the company and it had filed a criminal complaint for the illegal use of its aircraft. Japan has formally asked the United States to extradite two Americans - a former Green Beret and his son - who also stand accused of helping Ghosn flee Japan. They were arrested in Massachusetts in May.

Renault, Nissan limit French government interference

Renault and Nissan are taking action to limit the influence that one can exercise over the other's operations. The measures, announced by both automakers after meetings of their respective boards in Paris and Tokyo, aim to keep each other at arm's length. But more than that, they seek to cap the degree of influence which the French government can bring to bear on either automaker. The steps are being taken in response to investment moves by the French state. While the government's investment arm – known as the Agence des Participations de l'Etat (or state participation agency) – previously controlled 15 percent of Renault's shares, it increased its holdings this April to 19.73 percent. The action sparked concerns at Renault that the French government would attempt to dictate operating procedures to both automakers, potentially to favor production in France over other locations. Given that Renault holds a 43-percent stake in Nissan, the Japanese automaker grew concerned over potential French state interference as well. To assuage those concerns, Renault, Nissan, and the French government came to an agreement with three vital clauses. Most importantly, despite its nearly 20-percent holdings, the French government will be granted only 17.9 percent of voting rights in Renault (to be extended up to 20 percent under certain exceptional circumstances). Renault (and by extension the French government) will also be prevented from interfering in Nissan's governance. With those measures in place, Nissan will not seek more voting rights based on the 15-percent stake which it, in turn, holds in Renault. Having successfully concluded the deal and hedged against the threat of government interference, the Renault board reasserted its confidence in Carlos Ghosn. Through the unique terms of their alliance, Ghosn serves as chairman and CEO of both Renault and Nissan. The two cooperate closely and share resources extending far beyond their chief executive, but remain distinct companies rather than merge, as Fiat and Chrysler have. Carlos Ghosn vows to 'restore my honor' in first remarks since arrest

TOKYO — Nissan Motor's jailed ex-chairman, Carlos Ghosn, vowed to restore his good name in court after a month in detention, Japanese public broadcaster NHK said on Friday. "Things as they stand are absolutely unacceptable," Ghosn was quoted as saying via his lawyer. "I want to have my position heard and restore my honor in court." It was Ghosn's first comment since his arrest on Nov 19 for allegedly understating his income by about half over a five-year period from 2010. He was later charged with the same alleged crime covering the past three years. A call to the office of his lawyer, Motonari Otsuru, went unanswered outside business hours early on Friday. The lawyer has previously declined to return calls for comment on the Ghosn case. A Tokyo court on Thursday unexpectedly rejected prosecutors' request to extend Ghosn's detention, which Japanese media said means he could go free on bail as early as Friday. Ghosn wants to hold a news conference after he is released, NHK quoted his lawyer as saying. The executive, who formed a carmaking alliance among Nissan, Mitsubishi Motors Corp and France's Renault SA, said he is not a flight risk and wants to be able to travel abroad, the report said. The Ghosn case has put Japan's criminal justice system under international scrutiny and sparked criticism for some of its practices, including keeping suspects in detention for long periods and prohibiting defense lawyers from being present during interrogations, which can last eight hours a day. Japan has also come under fire for its 99.9 percent conviction rate. The Tokyo court unexpectedly ruled not to extend Ghosn's detention. It said it had also decided against extending detention for Greg Kelly, a former Nissan executive who was arrested along with Ghosn on Nov. 19. It later overruled an appeal by prosecutors against the decision, clearing the way for the possible release of the two men as early as Friday. The court did not disclose reasons for its decision, and NHK said it was "extremely rare" for it to reject the prosecutors' request to extend detention. If Ghosn and Kelly are granted bail, conditions may require them to apply for permission to travel overseas. They could also be barred from contacting Nissan officials.
