Carlos Ghosn changes to hotshot attorney and a new defense strategy

TOKYO — Carlos Ghosn's chief defense attorney Motonari Otsuru resigned and was replaced by a team that includes hotshot lawyer Junichiro Hironaka, in a change of strategy from the ousted Nissan Motor chairman three months after his arrest. Ghosn, Nissan's one-time savior, has been held in detention since his Nov. 19 arrest. He's been indicted and accused of under-reporting his salary and breach of trust. He has denied the charges. The once-feted auto executive hired Hiroshi Kawatsu as head of a new defense team, his office said on Wednesday. Hironaka, 73, has won several high profile cases, helping acquit senior lawmaker Ichiro Ozawa and senior bureaucrat Atsuko Muraki. Hiring Hironaka would mean a more aggressive legal strategy, said Nobuo Gohara, a former prosecutor. Otsuru previously led the special prosecutors' office that is now handling Ghosn's case. "Otsuru was miscast. He worked at the heart of the special prosecutors office so he was not someone who was going to go after them aggressively," Gohara said. "Hironaka is an experienced defense lawyer who has won a number of cases. He will mount a more thorough and aggressive defense." Otsuru's office confirmed his resignation in a statement, but gave no reason for the move. A second member of Ghosn's defense team, Masato Oshikubo, had quit, it said. Go Kondo, Ghosn's third defense lawyer, was unavailable for comment. Ghosn released a short statement thanking Otsuru for his team's "tireless and diligent work," and called him a "very capable and intelligent man and lawyer." The sudden change in attorneys comes ahead of the expected start of informal meetings with prosecutors and judges to discuss pretrial preparations, an indication that there will be no new charges against Ghosn. "As we begin the trial phase, I have decided to engage Hironaka-sensei as my legal counsel," Ghosn said, using an honorific suffix. "I look forward to defending myself vigorously, and this represents the beginning of the process of not only establishing my innocence but also shedding light on the circumstances that led to my unjust detention." Ghosn, 64, told the Nikkei newspaper last month that Nissan executives opposed to his plans for closer ties with automaking partner Renault SA had plotted to remove him. Ghosn was widely credited with rescuing Nissan from near-bankruptcy after he was brought over to Japan in 1999 by Renault after the French automaker bought a chunk of Nissan.

Nissan Leaf's lead over Renault Zoe narrows in Europe

The Nissan Leaf has seen its sales steadily decline in the US for a while now. Here, its been eclipsed by the second-generation Chevrolet Volt extended-range plug-in while people await the next-generation version of the all-electric Leaf. The EV may be starting to receive a similar response across the Pond. While the Leaf remains Europe's biggest-selling EV, that lead is eroding, as sales of the Renault Zoe are catching up, according to the European Alternative Fuels Observatory (EAFO). It's a good thing Nissan and Renault are sister companies. Through May, Nissan sold about 9,500 Leaf vehicles in Europe. The good news is that number is up 37 percent from a year earlier. There's disconcerting news, too, and that is that the Renault Zoe's sales have surged 60 percent this year to almost 9,400 units. So, for all we know, the Zoe may have caught up with the Leaf last month. Still, both models are outpacing demand for the Tesla Model S and Volkswagen e-Golf: the former's sales are little-changed this year, while the latter model's sales have dropped 34 percent. The BMW i3, Kia Soul EV, and Mercedes-Benz B250e all have had higher sales this year. As for plug-in hybrids, the Mitsubishi Outlander PHEV has maintained its substantial European lead, almost doubling sales of the Volkswagen Golf GTE and totaling almost 9,400 units sold through May. Meanwhile, the new Volvo XC90 PHEV has leapfrogged models such as the Volkswagen Passat GTE, Mercedes-Benz C350e, and Audi A3 e-Tron into third place behind the Mitsubishi and VW. Here in the US, Nissan Leaf sales through June fell 41 percent from a year earlier to about 5,800 units, while Chevrolet Volt sales have surged 75 percent to 9,808 units. Angry Nissan Leaf Driver may make 'Rolling Coal' illegal in New Jersey

It's always a few bad apples who ruin polluting just for fun for the rest of us. That time-honored American tradition of being rude for laughs, otherwise known as 'rolling coal,' might become illegal in New Jersey, if a Nissan Leaf-driving politician gets his way. The politician in question is State Assemblyman Tim Eustace (D-Bergen), who was purposefully hit by a blast of dark smoke recently while driving his Leaf on the New Jersey Turnpike, according to NJ.com. This personal experience of what he called "just youthful ignorance" is encouraging him to submit a bill (A3583), which, "Prohibits retrofitting diesel-powered vehicles to increase particulate emissions for the purpose of 'coal rolling'; prohibits the practice of 'coal rolling.'" If you're caught violating the law, you would be hit with a fine from the state Department of Environmental Protection. Of course, the Feds say it is already illegal to modify an exhaust system in a way that allows coal rolling. Rolling coal has become a bit of a meme recently, with videos of laughing truck drivers spewing their modified exhaust pipes at green cars, pedestrians and bikers around the country. Eustace told NJ.com that, "People had been telling this has been going on, but I hadn't seen it. I was surprised to experience it myself."
