Internal Nissan emails reportedly corroborate Ghosn's claim of a setup

An internal email trail reportedly supports former boss Carlos Ghosn's claim that Nissan orchestrated his ouster. The leaked emails have been corroborated by sources familiar with their contents, Bloomberg reports.  Emails going back to February 2018, a year before his arrest, allegedly describe a deliberate and multi-pronged effort — a "methodical campaign," Bloomberg said — to remove Ghosn from the company and in so doing, put Nissan in position to negotiate a more favorable relationship with alliance partner Renault.  The initial effort was apparently triggered by Ghosn's announcement in 2018 that he wanted to further intertwine Renault and Nissan, eventually to the point where their integration would be irreversible. Former Ghosn aide Hari Nada, who would appear as the whistleblower figure who outed Ghosn for his alleged financial misconduct, allegedly suggested to a Nissan senior manager that company executives should move to "neutralize his initiatives before itÂ’s too late." Nada would later recommend the termination of the agreement governing the Renault-Nissan Alliance. This would have granted Nissan broader freedom to purchase stake in Renault (or even ultimately take it over entirely), and reduce the French automaker's influence over Nissan's ability to choose its own executives.  The next day, Ghosn was arrested at Haneda Airport in Tokyo on charges of financial misconduct, including personal use of company money and under-reporting of income.  Ghosn, who was released and re-arrested multiple times, fled Japan illegally in January, taking refuge in his former home of Lebanon. Carlos Ghosn, a year after arrest, still seeks trial date and access to evidence

TOKYO — A year after his arrest, Nissan ex-Chairman Carlos Ghosn remains stuck in Tokyo under stringent bail conditions and without a trial date as he seeks access to a trove of Nissan emails and other evidence to fight charges of financial misconduct. His lawyers have asked a court to grant access to 6,000 pieces of evidence collected from Nissan such as electronic communications, which they say is crucial for a fair trial, showed an Oct. 4 court filing seen by Reuters. The once-feted executive has spent 129 days in detention since his arrest shortly after his private jet touched down at a Tokyo airport on Nov. 19, 2018. He faces four charges — which he denies — including hiding income and enriching himself through payments to dealerships in the Middle East. Nissan sacked Ghosn, saying its internal investigations revealed misconduct ranging from understating his salary while he was its chief executive, and transferring $5 million of Nissan funds to an account in which he had an interest. An earlier court ruling allowed prosecutors to hand back evidence to Nissan during pretrial wrangling over witnesses and evidence similar to the U. S. discovery process. If prosecutors are "given the freedom to unilaterally delete the collected evidence and return it to relevant parties, this is equivalent to granting the investigative agencies the right to destroy evidence," showed the filing to the Tokyo District Court. The lawyers also asked the court to rescind the earlier ruling, saying some evidence could be erased by Nissan to protect confidential business information. They argued the "ruling deprives Mr. Ghosn of his right to receive a fair public trial by an impartial court," as it enabled prosecutors to view and use the evidence and withhold it from the defense. Prosecutors are not required to hand over all evidence they or the police gather during investigations unless ordered by the court, unlike in the U.S. discovery process where prosecutors and defense lawyers disclose the evidence they intend to present in court. A spokeswoman for the Tokyo prosecutors' office said the office could not comment on individual cases. A Nissan spokeswoman declined to comment. Ghosn's lawyers have also asked the court to dismiss all charges against him, accusing prosecutors of colluding with government officials and Nissan executives to oust him to block any takeover of the automaker by French alliance partner Renault SA, of which Ghosn was also chairman.

Hyundai plots a Nissan Juke fighter

A few years ago, Hyundai Motor America CEO Dave Zuchowski suggested interest in taking on the Nissan Juke with a subcompact crossover. It looks like that project is coming together, as we caught Hyundai testing a small, curiously-styled SUV in Germany recently. The SUV is expected to share a lot of the same chassis components as the i20, a hatchback that's sold in other parts of the world, with the same engine lineup as the new i30, another hatchback that Hyundai doesn't sell in the America. In the United Kingdom, the i30 is available with engines including a 1.4-liter gasoline and a 1.6-liter diesel unit. Front-wheel drive would be standard with all-wheel drive an option. The heavily-camouflaged prototype doesn't give away a lot of the SUV's design. The front of the vehicle is hidden away, but what we can see the grille features hexagonal shapes instead of the horizontal bars that we've become accustomed to seeing in Hyundais. The headlights mimic the Jeep Cherokee's design with thin slits on top and larger, round units toward the bottom. At the back, camouflage hides the majority of the prototype, but the taillights appear to be different than the rest of Hyundai's offerings. The outline of the taillights resembles the same units found on the Intrado Concept, indicating the vehicle will get some design cues from the hydrogen-powered prototype. A single exhaust outlet protrudes underneath the rear end. The overall profile of the SUV appears to be smaller than the Tucson, which is currently Hyundai's smallest crossover in the US.
